Hadith 4402 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)

Rapporté par Ali ibn AbuTalib رضي الله عنه : AbuZubyan a dit : Une femme ayant commis l’adultère fut amenée à Omar. Il ordonna qu’elle soit lapidée. Ali passa à ce moment-là, la saisit et la relâcha. Omar en fut informé et dit : Faites venir Ali. Ali vint et dit : Commandeur des croyants, tu sais que le Messager d’Allah ﷺ a dit : « Il y a trois personnes dont les actes ne sont pas inscrits : un garçon jusqu’à ce qu’il atteigne la puberté, une personne qui dort jusqu’à son réveil, et une personne folle jusqu’à ce qu’elle retrouve la raison. » Cette femme est une idiote (folle) de la famille d’untel. Quelqu’un a pu faire cela avec elle alors qu’elle était en crise de folie. Omar répondit : Je ne sais pas. Ali dit : Je ne sais pas non plus

حَدَّثَنَا هَنَّادٌ، عَنْ أَبِي الأَحْوَصِ، ح وَحَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا جَرِيرٌ، - الْمَعْنَى - عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ أَبِي ظَبْيَانَ، - قَالَ هَنَّادٌ - الْجَنْبِيِّ قَالَ أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ فَجَرَتْ فَأَمَرَ بِرَجْمِهَا فَمَرَّ عَلِيٌّ رضى الله عنه فَأَخَذَهَا فَخَلَّى سَبِيلَهَا فَأُخْبِرَ عُمَرُ قَالَ ادْعُوا لِي عَلِيًّا . فَجَاءَ عَلِيٌّ رضى الله عنه فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ لَقَدْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " رُفِعَ الْقَلَمُ عَنْ ثَلاَثَةٍ عَنِ الصَّبِيِّ حَتَّى يَبْلُغَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمَعْتُوهِ حَتَّى يَبْرَأَ " . وَإِنَّ هَذِهِ مَعْتُوهَةُ بَنِي فُلاَنٍ لَعَلَّ الَّذِي أَتَاهَا أَتَاهَا وَهِيَ فِي بَلاَئِهَا . قَالَ فَقَالَ عُمَرُ لاَ أَدْرِي . فَقَالَ عَلِيٌّ عَلَيْهِ السَّلاَمُ وَأَنَا لاَ أَدْرِي .
Traduction anglaise
Narrated Ali ibn AbuTalib: AbuZubyan said: A woman who had committed adultery was brought to Umar. He gave orders that she should be stoned. Ali passed by just then. He seized her and let her go. Umar was informed of it. He said: Ask Ali to come to me. Ali came to him and said: Commander of the Faithful, you know that the Messenger of Allah (ﷺ) said: There are three (people) whose actions are not recorded: A boy till he reaches puberty, a sleeper till he awakes, a lunatic till he is restored to reason. This is an idiot (mad) woman belonging to the family of so and so. Someone might have done this action with her when she suffered the fit of lunacy. Umar said: I do not know. Ali said: I do not know

ابوظبیان جنی کہتے ہیں کہ عمر رضی اللہ عنہ کے پاس ایک عورت لائی گئی جس نے زنا کا ارتکاب کیا تھا، تو انہوں نے اسے رجم کرنے کا حکم دیا، علی رضی اللہ عنہ کا وہاں سے گزر ہوا، انہوں نے اسے پکڑا اور چھوڑ دیا، تو عمر کو اس کی خبر دی گئی تو انہوں نے کہا: علی رضی اللہ عنہ کو میرے پاس بلاؤ، چنانچہ علی رضی اللہ عنہ آئے اور کہنے لگے: امیر المؤمنین! آپ کو معلوم ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ہے: قلم تین شخصوں سے اٹھا لیا گیا ہے: بچہ سے یہاں تک کہ وہ بالغ ہو جائے، سوئے ہوئے شخص سے یہاں تک کہ وہ بیدار ہو جائے، اور دیوانہ سے یہاں تک کہ وہ اچھا ہو جائے اور یہ تو دیوانی اور پاگل ہے، فلاں قوم کی ہے، ہو سکتا ہے اس کے پاس جو آیا ہو اس حالت میں آیا ہو کہ وہ دیوانگی کی شدت میں مبتلاء رہی ہو، تو عمر رضی اللہ عنہ نے کہا: مجھے نہیں معلوم کہ وہ اس وقت دیوانی تھی، اس پر علی رضی اللہ عنہ نے کہا: مجھے یہ بھی نہیں معلوم کہ وہ نہیں تھی۔
