Hadith 2079 — Livre 12: Marriage (Kitab Al-Nikah)
كتاب النكاح
Ibn ‘Umar رضي الله عنه a rapporté que le Prophète ﷺ a dit : « Si un esclave se marie sans la permission de son maître, son mariage est nul. » Abu Dawud a dit : « Ce récit est faible. Il est mauquf (il ne remonte pas au Prophète). C’est la parole de Ibn ‘Umar lui-même. »

Texte arabe original
حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ، حَدَّثَنَا أَبُو قُتَيْبَةَ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " إِذَا نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلاَهُ فَنِكَاحُهُ بَاطِلٌ " . قَالَ أَبُو دَاوُدَ هَذَا الْحَدِيثُ ضَعِيفٌ وَهُوَ مَوْقُوفٌ وَهُوَ قَوْلُ ابْنِ عُمَرَ رضى الله عنهما .
Traduction anglaise
Ibn ‘Umar reported the Prophet (ﷺ) as saying “If a slave marries without the permission of his master, his marriage is null and void. Abu Dawud said “This tradition is weak. This is mauquf(does not go back to the Prophet). This is the statement of the Ibn ‘Umar himself
Traduction en ourdou
عبداللہ بن عمر رضی اللہ عنہما سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: جب غلام اپنے مالک کی اجازت کے بغیر نکاح کرے تو اس کا نکاح باطل ہے ۔ ابوداؤد کہتے ہیں: یہ حدیث ضعیف، اور موقوف ہے، یہ ابن عمر رضی اللہ عنہما کا قول ہے۔
