Hadith 3747 — Livre 34: The Book of 'Umra
كتاب العُمرى
Rapporté par Ibn Abi Dhi'b, d'après Ibn Shihab, d'après Abu Salamah, de Jabir, que le Messager d'Allah ﷺ a jugé — concernant une personne à qui l'on a fait un don à vie ('Umra) — que cela lui appartient ainsi qu'à ses descendants : "Cela lui appartient sans aucun doute, et il n'est pas permis au donateur de poser des conditions ou des exceptions." Abu Salamah a dit : "Parce qu'il l'a donné comme un don, il est donc soumis à la même règle que l'héritage, et la condition (qu'il revienne au donateur à la mort du bénéficiaire) est devenue invalide

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ، عَنِ ابْنِ أَبِي فُدَيْكٍ، قَالَ حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِيمَنْ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَهِيَ لَهُ بَتْلَةٌ لاَ يَجُوزُ لِلْمُعْطِي مِنْهَا شَرْطٌ وَلاَ ثُنْيَا . قَالَ أَبُو سَلَمَةَ لأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ فَقَطَعَتِ الْمَوَارِيثُ شَرْطَهُ .
Traduction anglaise
Ibn Abi Dhi'b narrated from Ibn Shihab, from Abu Salamah, from Jabir, that the Messenger of Allah ruled -concerning a person who has been given a lifelong gift ('Umra)- that it belongs to him and to his descendants:"It is undoubtedly his, and it is not permissible for the giver to stipulate any conditions or exceptions." Abu Salamah said: "Because he gave it as a gift and thus, it is subject to the same ruling as the estate, and the condition (that it will revert to the giver on the death of recipient) has become invalid
Traduction en ourdou
جابر رضی الله عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے اس شخص کے بارے میں جسے کوئی چیز عمری کی گئی ہو کہ یہ اس کا اور اس کی اولاد کا ہے فیصلہ صادر فرمایا کہ دینے والے کو اس میں کوئی شرط لگانا اور کوئی استثناء کرنا جائز و درست نہیں ہے۔ ابوسلمہ کہتے ہیں: اس نے ایسا عطیہ دیا ہے جس میں میراث کا قانون ہو گیا اور اس کی شرط کو باطل کر دیا ( یعنی وہ شرط لغو قرار دے دی ) ۔
