Hadith 1180 — Livre 29: Divorce
كتاب الطلاق
Nafe' a rapporté que Abdallah Ibn Omar disait au sujet de l'esclave mariée avec un esclave et elle est affranchie, l'esclave aura à elle le choix de garder son mari, ou de divorcer d'avec lui, tant que ce dernier ne l'aura pas touchée» (après être affranchie). Malek a dit: «Si son mari l'a touché, et qu'elle prétend ignorer, d'avoir eu à elle le choix, elle est dans ce cas, accusée, et l'on ne croit pas à ce qu'elle a prétendu de l'ignorance. Et il ne lui revient plus le choix de divorcer d'avec son mari après qu'il l'ait touchée»

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّهُ كَانَ يَقُولُ فِي الأَمَةِ تَكُونُ تَحْتَ الْعَبْدِ فَتَعْتِقُ إِنَّ الأَمَةَ لَهَا الْخِيَارُ مَا لَمْ يَمَسَّهَا . قَالَ مَالِكٌ وَإِنْ مَسَّهَا زَوْجُهَا فَزَعَمَتْ أَنَّهَا جَهِلَتْ أَنَّ لَهَا الْخِيَارَ فَإِنَّهَا تُتَّهَمُ وَلاَ تُصَدَّقُ بِمَا ادَّعَتْ مِنَ الْجَهَالَةِ وَلاَ خِيَارَ لَهَا بَعْدَ أَنْ يَمَسَّهَا .
Traduction anglaise
ahya related to me from Malik from Nafi that Abdullah ibn Umar said that a female slave who was the wife of a slave and then was set free, had the right of choice as long as he did not have intercourse with her. Malik said, "If her husband has intercourse with her and she claims that she did not know, she still has the right of choice. If she is suspect and one does not believe her claim of ignorance, then she has no choice after he has had intercourse with her
Traduction en ourdou
عبداللہ بن عمر کہتے تھے کہ لونڈی اگر غلام کے نکاح میں ہو پھر آزاد ہو جائے تو اس کو اختیار ہوگا آزادی کے بعد جب تک اس کا شوہر اس اس سے جماع نہ کرے ۔ کہا مالک نے اگر خاوند نے آزادی کے بعد اس سے جماع کیا اور لونڈی نے یہ کہا کہ مجھ کو یہ اختیار کا مسئلہ معلوم نہیں تھا تو عذر اس کا مسموع نہ ہوگا اور اس کو اختیار نہ رہے گا۔
