Hadith 1178 — Livre 29: Divorce
كتاب الطلاق
Malek a rapporté qu'il a demandé Ibn Chéhab au sujet de la répudiation des esclaves selon la formule: «Sois pour moi comme le dos de ma mère». Il lui dit: «Ils sont soumis aux mêmes conditions qu'un homme libre». * Malek a dit: * «L'esclave est considéré dans les mêmes conditions qu'un homme libre». * «Ce genre de répudiation est une obligation pour l'esclave, et doit en revanche l'expier en jeûnant pour deux mois de suite». * «Lorsque l'esclave compare sa femme au dos de sa propre mère», cela n'est pas considéré comme un serment de répudiation, car s'il allait faire le jeûne qui est celui de l'expiation de deux mois, tout comme un homme libre, il serait obligé de divorcer avant qu'il ne termine son jeûne». حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، أَنَّهُ سَأَلَ ابْنَ شِهَابٍ عَنْ ظِهَارِ الْعَبْدِ، فَقَالَ نَحْوُ ظِهَارِ الْحُرِّ . قَالَ مَالِكٌ يُرِيدُ أَنَّهُ يَقَعُ عَلَيْهِ كَمَا يَقَعُ عَلَى الْحُرِّ . قَالَ مَالِكٌ وَظِهَارُ الْعَبْدِ عَلَيْهِ وَاجِبٌ وَصِيَامُ الْعَبْدِ فِي الظِّهَارِ شَهْرَانِ . قَالَ مَالِكٌ فِي الْعَبْدِ يَتَظَاهَرُ مِنِ امْرَأَتِهِ إِنَّهُ لاَ يَدْخُلُ عَلَيْهِ إِيلاَءٌ وَذَلِكَ أَنَّهُ لَوْ ذَهَبَ يَصُومُ صِيَامَ كَفَّارَةِ الْمُتَظَاهِرِ دَخَلَ عَلَيْهِ طَلاَقُ الإِيلاَءِ قَبْلَ أَنْ يَفْرُغَ مِنْ صِيَامِهِ .
Traduction anglaise
ahya related to me from Malik that he asked Ibn Shihab about the dhihar of a slave. He said, "It is like the dhihar of a free man." Malik said, "He meant that the same conditions were applied in both cases." Malik said, "The dhihar of the slave is incumbent on him, and the fasting of the slave in the dhihar is two months. " Malik said that there was no ila for a slave who pronounced a dhihar from his wife. That was because if he were to fast the kaffara for pronouncing a dhihar, the divorce of the ila would come to him before he had finished the fast

مالک نے ابن شہاب سے پوچھا ظہار کے غلام کا حال تو انہوں نے کہا آزاد کی طرح ہے ۔ کہا مالک نے مطلب یہ ہے کہ غلام پر بھی کفارہ لازم آتا ہے جیسے آزد پر ۔ کہا مالک نے غلام بھی ظہار میں دو مہینے کے روزے رکھے ۔ کہا مالک نے ظہار کے غلام میں ایلاء شریک نہ ہوگا کیونکہ غلام جب دو مہینے کے روزے رکھے گا ایلاء کی طلاق پہلے ہی پڑ جائے گی۔
