كتاب الوصايا
Rapporté par 'Amr bin Kharijah : Le Prophète (ﷺ) s’est adressé à eux alors qu’il était sur son chameau. Son chameau ruminait et sa salive coulait entre mes épaules. Il a dit : “Allah (SWT) a attribué à chaque héritier sa part d’héritage, donc il n’est pas permis de faire un legs en faveur d’un héritier. L’enfant appartient au lit conjugal et l’adultère n’a droit qu’à la pierre. Celui qui prétend appartenir à quelqu’un d’autre que son père, ou (un affranchi) qui prétend que son Wala est pour d’autres que ses maîtres, sur lui sera la malédiction d’Allah, des anges et de tous les gens, et aucune compensation ni échange équitable ne sera accepté de lui.” Ou il a dit : “Aucun échange équitable ni changement.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنْ شَهْرِ بْنِ حَوْشَبٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، عَنْ عَمْرِو بْنِ خَارِجَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم خَطَبَهُمْ وَهُوَ عَلَى رَاحِلَتِهِ وَإِنَّ رَاحِلَتَهُ لَتَقْصَعُ بِجِرَّتِهَا وَإِنَّ لُغَامَهَا لَيَسِيلُ بَيْنَ كَتِفَىَّ قَالَ " إِنَّ اللَّهَ قَسَمَ لِكُلِّ وَارِثٍ نَصِيبَهُ مِنَ الْمِيرَاثِ فَلاَ يَجُوزُ لِوَارِثٍ وَصِيَّةٌ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَمَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ أَوْ تَوَلَّى غَيْرَ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ لاَ يُقْبَلُ مِنْهُ صَرْفٌ وَلاَ عَدْلٌ " . أَوْ قَالَ " عَدْلٌ وَلاَ صَرْفٌ " .
Traduction anglaise
It was narrated from 'Amr bin Kharijah:“The Prophet (ﷺ) addressed them when he was on his camel. His camel was chewing its cud and its saliva was dripping between my shoulders. He said: 'Allah (SWT) has allocated for each heir his share of the inheritance, so it is not permissible (to make) a bequest for an heir. The child belong to the bed and the adulterer gets the stone. Whoever claims to belong to someone other than his father, or (a freed slave) who claims that his Wala is for other than his Mavali, upon him will be the curse of Allah, the angels and all the people, and no charge nor equitable exchange will be accepted from him.” Or he said: “No equitable exchange nor change.”

عمرو بن خارجہ رضی اللہ عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے لوگوں کو اس حال میں خطبہ دیا کہ آپ اپنی سواری ( اونٹنی ) پر تھے، وہ جگالی کر رہی تھی، اور اس کا لعاب میرے مونڈھوں کے درمیان بہہ رہا تھا، آپ صلی اللہ علیہ وسلم نے فرمایا: اللہ تعالیٰ نے ہر وارث کے لیے میراث کا حصہ متعین کر دیا ہے، لہٰذا کسی وارث کے لیے وصیت جائز نہیں، بچہ اس کا ہے جس کے بستر پر اس کی ولادت ہوئی، اور زنا کرنے والے کے لیے پتھر ہے، جو شخص اپنے باپ دادا کے علاوہ دوسرے کی طرف نسبت کا دعویٰ کرے یا ( غلام ) اپنے مالک کے علاوہ دوسرے شخص کو مالک بنائے، تو اس پر اللہ تعالیٰ، فرشتوں اور سب لوگوں کی لعنت ہے، نہ اس کا نفل قبول ہو گا، نہ فرض یا یوں کہا کہ نہ فرض قبول ہو گا نہ نفل ۱؎۔
