Hadith 2612 — Livre 20: The Chapters on Legal Punishments
كتاب الحدود
Rapporté par Muslim bin Haisam, d’après Ash’ath bin Qais : “Je suis venu voir le Messager d’Allah (ﷺ) avec une délégation de Kindah, et ils pensaient que j’étais le meilleur d’entre eux. J’ai dit : ‘Ô Messager d’Allah (ﷺ), n’es-tu pas des nôtres ?’ Il a répondu : ‘Nous sommes de la tribu de Banu Nadr bin Kinanah, et nous ne nous réclamons pas de notre mère et nous ne renions pas nos ancêtres.’” Ash’ath bin Qais disait : “Si un homme vient à moi et prétend qu’un homme de Quraish n’appartient pas à Nadr bin Kinanah, j’appliquerai la peine légale (pour calomnie) contre lui.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، ح وَحَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، ح وَحَدَّثَنَا هَارُونُ بْنُ حَيَّانَ، أَنْبَأَنَا عَبْدُ الْعَزِيزِ بْنُ الْمُغِيرَةِ، قَالاَ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ عَقِيلِ بْنِ طَلْحَةَ السُّلَمِيِّ، عَنْ مُسْلِمِ بْنِ هَيْصَمٍ، عَنِ الأَشْعَثِ بْنِ قَيْسٍ، قَالَ أَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فِي وَفْدِ كِنْدَةَ وَلاَ يَرَوْنِي أَفْضَلَهُمْ فَقُلْتُ يَا رَسُولَ اللَّهِ أَلَسْتُمْ مِنَّا . فَقَالَ " نَحْنُ بَنُو النَّضْرِ بْنِ كِنَانَةَ لاَ نَقْفُو أُمَّنَا وَلاَ نَنْتَفِي مِنْ أَبِينَا " . قَالَ فَكَانَ الأَشْعَثُ بْنُ قَيْسٍ يَقُولُ لاَ أُوتَى بِرَجُلٍ نَفَى رَجُلاً مِنْ قُرَيْشٍ مِنَ النَّضْرِ بْنِ كِنَانَةَ إِلاَّ جَلَدْتُهُ الْحَدَّ .
Traduction anglaise
Muslim bin Haisam narrated from Ash'ath bin Qais who said:“I came to the Messenger of Allah (ﷺ) with a delegation from Kindah, and they thought that I was the best of them. I said: 'O Messenger of Allah (ﷺ) are you not from among us?' He said: 'We are the tribe of Banu Nadr bin Kinanah, and we do not attribute ourselves to our mother and we do not deny our forefathers.'”He said: “Ash'ath bin Qais used to say: 'If any man is brought to me who suggests that a man from Quraish does not belong to Nadr bin Kinanah, I would carry out the legal punishment (for slander) on him.'”

اشعث بن قیس رضی اللہ عنہ کہتے ہیں کہ میں قبیلہ کندہ کے وفد میں رسول اللہ صلی اللہ علیہ وسلم کے پاس آیا، وہ لوگ مجھے سب سے بہتر سمجھتے تھے، میں نے عرض کیا: اللہ کے رسول! کیا آپ لوگ ہم میں سے نہیں ہیں؟ آپ صلی اللہ علیہ وسلم نے فرمایا: ہم نضر بن کنانہ کی اولاد ہیں، نہ ہم اپنی ماں پر تہمت لگاتے ہیں، اور نہ اپنے والد سے علیحدہ ہوتے ہیں ۔ راوی کہتے ہیں: اشعث بن قیس رضی اللہ عنہ کہا کرتے تھے کہ میرے پاس اگر کوئی ایسا شخص آئے جو کسی قریشی کے نضر بن کنانہ کی اولاد میں سے ہونے کا انکار کرے، تو میں اسے حد قذف لگاؤں گا۔
