Hadith 4374 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)

Rapporté par Aïcha رضي الله عنها : Une femme de la tribu Makhzoum empruntait des objets et niait les avoir reçus, alors le Prophète ﷺ a ordonné qu’on lui coupe la main. Le rapporteur a ensuite transmis le reste de la tradition comme celle d’al-Laith, disant : Ainsi, le Prophète ﷺ lui a fait couper la main. Abu Dawud a dit : Ibn Wahb a transmis cette tradition de Yunus d’après al-Zuhri, et dans cette version il a dit : al-Laith a dit : Une femme a commis un vol à l’époque du Prophète ﷺ lors de la conquête de La Mecque. Cela a été transmis par al-Laith de Yunus d’après Ibn Shihab avec sa chaîne de rapporteurs. Il a dit dans cette version : Une femme a emprunté des objets. Mas‘ud ibn al-Aswad a aussi transmis une tradition similaire du Prophète ﷺ et a dit : Un tissu de velours a été volé dans la maison du Messager d’Allah ﷺ. Abu Dawud a dit : Abu al-Zubair a rapporté d’après Jabir : Une femme a volé et s’est réfugiée auprès de Zainab, fille du Prophète ﷺ

حَدَّثَنَا عَبَّاسُ بْنُ عَبْدِ الْعَظِيمِ، وَمُحَمَّدُ بْنُ يَحْيَى، قَالاَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، رضى الله عنها قَالَتْ كَانَتِ امْرَأَةٌ مَخْزُومِيَّةٌ تَسْتَعِيرُ الْمَتَاعَ وَتَجْحَدُهُ فَأَمَرَ النَّبِيُّ صلى الله عليه وسلم بِقَطْعِ يَدِهَا وَقَصَّ نَحْوَ حَدِيثِ اللَّيْثِ قَالَ فَقَطَعَ النَّبِيُّ صلى الله عليه وسلم يَدَهَا . قَالَ أَبُو دَاوُدَ رَوَى ابْنُ وَهْبٍ هَذَا الْحَدِيثَ عَنْ يُونُسَ عَنِ الزُّهْرِيِّ وَقَالَ فِيهِ كَمَا قَالَ اللَّيْثُ إِنَّ امْرَأَةً سَرَقَتْ فِي عَهْدِ النَّبِيِّ صلى الله عليه وسلم فِي غَزْوَةِ الْفَتْحِ . وَرَوَاهُ اللَّيْثُ عَنْ يُونُسَ عَنِ ابْنِ شِهَابٍ بِإِسْنَادِهِ فَقَالَ اسْتَعَارَتِ امْرَأَةٌ . وَرَوَى مَسْعُودُ بْنُ الأَسْوَدِ عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَ هَذَا الْخَبَرِ قَالَ سُرِقَتْ قَطِيفَةٌ مِنْ بَيْتِ رَسُولِ اللَّهِ صلى الله عليه وسلم . قَالَ أَبُو دَاوُدَ وَرَوَاهُ أَبُو الزُّبَيْرِ عَنْ جَابِرٍ أَنَّ امْرَأَةً سَرَقَتْ فَعَاذَتْ بِزَيْنَبَ بِنْتِ رَسُولِ اللَّهِ صلى الله عليه وسلم .
Traduction anglaise
’A’ishah said:A Makhzumi woman used to borrow goods and deny having received them, so the prophet (ﷺ) gave orders that her hand should be cut off. The narrator than transmitted the rest of the tradition like that of al-laith, saying : So the prophet (ﷺ) had her hand cut off. Abu dawud said: Ibn Wahb transmitted this tradition from Yunus on the authority of al-Zuhri, and in this version he said al-Laith has said: A woman committed theft during the lifetime of the Prophet (ﷺ) on the occasion of the Conquest (of Mecca). It has been transmitted by al-Laith from Yunus on the authority of Ibn Shihab through his chain of narrators. He said in this version: A woman borrowed goods. Mas'ud bin al-Aswad also transmitted a similar tradition from the Prophet (ﷺ) and said: A velvet was stolen from the house of the Messenger of Allah (ﷺ). Abu Dawud said: Abu al-Zubair reported on the authority of Jabir: A woman committed theft and took refuge with Zainab daughter of Prophet (ﷺ)

ام المؤمنین عائشہ رضی اللہ عنہا کہتی ہیں کہ ایک مخزومی عورت سامان مانگ کر لے جایا کرتی اور واپسی کے وقت اس کا انکار کر دیا کرتی تھی، تو نبی اکرم صلی اللہ علیہ وسلم نے حکم دیا کہ اس کا ہاتھ کاٹ لیا جائے۔ اور معمر نے لیث جیسی روایت بیان کی اس میں ہے تو نبی اکرم صلی اللہ علیہ وسلم نے اس کا ہاتھ کاٹ لیا۔ ابوداؤد کہتے ہیں: ابن وہب نے اس حدیث کو یونس سے، یونس نے زہری سے روایت کیا، اور اس میں ویسے ہی ہے جیسے لیث نے کہا ہے کہ ایک عورت نے نبی اکرم صلی اللہ علیہ وسلم کے عہد میں فتح مکہ کے سال چوری کی۔ اور اسے لیث نے یونس سے، یونس نے ابن شہاب سے اسی سند سے روایت کیا ہے اس میں ہے کہ اس عورت نے ( کوئی چیز ) منگنی ( مانگ کر ) لی تھی ( پھر وہ مکر گئی تھی ) ۔ اور اسے مسعود بن اسود نے نبی اکرم صلی اللہ علیہ وسلم سے اسی حدیث کے مثل روایت کیا ہے اس میں یہ ہے کہ اس نے نبی اکرم صلی اللہ علیہ وسلم کے گھر سے ایک چادر چرائی تھی۔ اور ابوزبیر نے جابر سے اسے یوں روایت کیا ہے کہ ایک عورت نے چوری کی، پھر اس نے رسول اللہ صلی اللہ علیہ وسلم کی صاحبزادی زینب کی پناہ لی۔
