Hadith 4373 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)

Rapporté par Aïcha رضي الله عنها : Les Quraysh étaient préoccupés au sujet d’une femme Makhzumi qui avait volé. Ils dirent : « Qui parlera au Messager d’Allah ﷺ à son sujet ? » Puis ils dirent : « Qui osera, sinon Usamah ibn Zayd, l’ami du Prophète ﷺ ? » Usamah lui parla, et le Messager d’Allah ﷺ dit : « Intercèdes-tu au sujet d’une peine prescrite par Allah ? » Puis il se leva et fit un discours, disant : « Ce qui a perdu ceux qui vous ont précédés, c’est que lorsqu’une personne de rang commettait un vol, ils la laissaient, et quand c’était une personne faible, ils lui appliquaient la peine. Par Allah, si Fatima, fille de Muhammad, volait, je lui couperais la main. »

حَدَّثَنَا يَزِيدُ بْنُ خَالِدِ بْنِ عَبْدِ اللَّهِ بْنِ مَوْهَبٍ الْهَمْدَانِيُّ، قَالَ حَدَّثَنِي ح، وَحَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ الثَّقَفِيُّ، حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، رضى الله عنها أَنَّ قُرَيْشًا، أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا تَعْنِي رَسُولَ اللَّهِ صلى الله عليه وسلم . قَالُوا وَمَنْ يَجْتَرِئُ إِلاَّ أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ صلى الله عليه وسلم فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " يَا أُسَامَةُ أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ " . ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ " إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا " .
Traduction anglaise
‘A’ishah said:The Quraish were anxious about the Makhzumi woman who had committed theft, They said : Who will speak to the Messenger of Allah(ﷺ) about her ? Then they said: Who will be bold enough for it but Uasmah bin Zaid, the prophet’s (ﷺ) friend! So Usamah spoke to him, and the Messenger of Allah(ﷺ) said : Are you interceding regarding one of the punishments prescribed by Allah ? He then got up and gave an address, saying : What destroyed your predecessors was just that when a person of rank among them committed a theft, They left him alone , and when a weak one of them committed a theft, they inflicted the prescribed punishment on him . I swear by Allah that if Fatimah daughter of Muhammad should steal, I would have her hand cut off
Traduction en ourdou
ام المؤمنین عائشہ رضی اللہ عنہا کہتی ہیں کہ قریش کو ایک مخزومی عورت جس نے چوری کی تھی کے معاملہ نے فکرمند کر دیا، وہ کہنے لگے: اس عورت کے سلسلہ میں کون رسول اللہ صلی اللہ علیہ وسلم سے بات کرے گا؟ لوگوں نے کہا: رسول اللہ صلی اللہ علیہ وسلم کے چہیتے اسامہ بن زید رضی اللہ عنہما کے سوا اور کس کو اس کی جرات ہو سکتی ہے؟ چنانچہ اسامہ رضی اللہ عنہ نے آپ سے اس سلسلہ میں گفتگو کی تو آپ صلی اللہ علیہ وسلم نے فرمایا: اسامہ! کیا تم اللہ کے حدود میں سے ایک حد کے سلسلہ میں مجھ سے سفارش کرتے ہو! پھر آپ صلی اللہ علیہ وسلم کھڑے ہوئے اور خطبہ دیا، آپ نے اس خطبہ میں فرمایا: تم سے پہلے کے لوگ اسی وجہ سے ہلاک ہوئے کیونکہ ان میں جب کوئی معزز آدمی چوری کرتا تو اسے چھوڑ دیتے اور جب کسی کمزور سے یہ جرم سرزد ہو جاتا تو اس پر حد قائم کرتے، قسم اللہ کی اگر فاطمہ بنت محمد بھی چوری کرے تو میں اس کا ہاتھ بھی کاٹ ڈالوں گا ۔
