Hadith 3520 — Livre 24: Wages (Kitab Al-Ijarah)

Rapporté par Abu Bakr ibn AbdurRahman ibn al-Harith ibn Hisham : Le Prophète ﷺ a dit : « Si un homme vend son bien et que l’acheteur devient insolvable, et que le vendeur n’a pas reçu le prix de ce bien, mais retrouve son bien chez l’acheteur, il est plus en droit de le reprendre que les autres. Si l’acheteur meurt, alors le propriétaire du bien est à égalité avec les autres créanciers. »

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " أَيُّمَا رَجُلٍ بَاعَ مَتَاعًا فَأَفْلَسَ الَّذِي ابْتَاعَهُ وَلَمْ يَقْبِضِ الَّذِي بَاعَهُ مِنْ ثَمَنِهِ شَيْئًا فَوَجَدَ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ وَإِنْ مَاتَ الْمُشْتَرِي فَصَاحِبُ الْمَتَاعِ أُسْوَةُ الْغُرَمَاءِ " .
Traduction anglaise
Narrated AbuBakr ibn AbdurRahman ibn al-Harith ibn Hisham: The Prophet (ﷺ) said: If a man sells (his) property and the man who buys it becomes insolvent, and the seller does not receive the price of the property he had sold, but finds his very property with him (i.e. the buyer), he is more entitled to it (than others). If the buyer dies, then the owner of the property is equal to the creditors
Traduction en ourdou
ابوبکر بن عبدالرحمٰن بن حارث بن ہشام کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جس آدمی نے اپنا سامان بیچا اور خریدار مفلس ہو گیا، اور بیچنے والے نے اپنے مال کی کوئی قیمت نہ پائی ہو، اور اس کا سامان خریدار کے پاس بعینہٖ موجود ہو تو وہ اپنا سامان واپس لے لینے کا زیادہ حقدار ہے، اور اگر خریدار مر گیا ہو تو سامان والا دوسرے قرض خواہوں کی طرح ہے ۔
