Rapporté par Hanzlah b. Qais al-Ansari رضي الله عنه : J’ai demandé à Rafi’ b. Khadij au sujet de la location de terres contre de l’or et de l’argent (c’est-à-dire des dinars et des dirhams). Il a répondu : « Il n’y a pas de mal à cela, car à l’époque du Messager d’Allah ﷺ, les gens louaient la terre pour ce qui poussait grâce à l’eau courante, au bord des ruisseaux ou dans les zones cultivées. Parfois, une partie de la récolte périssait et l’autre était sauvée, ou l’inverse. Il n’y avait pas d’autre forme de location parmi les gens. C’est pourquoi il l’a interdite. Mais si la chose est sûre et connue, il n’y a pas de mal. » La version d’Ibrahim est plus complète. Qutaibah a dit : « de Hanzalah, d’après Rafi’. » Abu Dawud a dit : Un hadith similaire a été transmis par Yahya b. Sa’id de Hanzalah

حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى الرَّازِيُّ، أَخْبَرَنَا عِيسَى، حَدَّثَنَا الأَوْزَاعِيُّ، ح وَحَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا لَيْثٌ، كِلاَهُمَا عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، - وَاللَّفْظُ لِلأَوْزَاعِيِّ - حَدَّثَنِي حَنْظَلَةُ بْنُ قَيْسٍ الأَنْصَارِيُّ، قَالَ سَأَلْتُ رَافِعَ بْنَ خَدِيجٍ عَنْ كِرَاءِ الأَرْضِ، بِالذَّهَبِ وَالْوَرِقِ فَقَالَ لاَ بَأْسَ بِهَا إِنَّمَا كَانَ النَّاسُ يُؤَاجِرُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم بِمَا عَلَى الْمَاذِيَانَاتِ وَأَقْبَالِ الْجَدَاوِلِ وَأَشْيَاءَ مِنَ الزَّرْعِ فَيَهْلِكُ هَذَا وَيَسْلَمُ هَذَا وَيَسْلَمُ هَذَا وَيَهْلِكُ هَذَا وَلَمْ يَكُنْ لِلنَّاسِ كِرَاءٌ إِلاَّ هَذَا فَلِذَلِكَ زَجَرَ عَنْهُ فَأَمَّا شَىْءٌ مَضْمُونٌ مَعْلُومٌ فَلاَ بَأْسَ بِهِ . وَحَدِيثُ إِبْرَاهِيمَ أَتَمُّ وَقَالَ قُتَيْبَةُ عَنْ حَنْظَلَةَ عَنْ رَافِعٍ . قَالَ أَبُو دَاوُدَ رِوَايَةُ يَحْيَى بْنِ سَعِيدٍ عَنْ حَنْظَلَةَ نَحْوَهُ .
Traduction anglaise
Narrated Hanzlah b. Qais al-Ansari: I asked Rafi' b. Khadij about the lease of land for gold and silver (i.e. for dinars and dirhams). There is no harm in it, for the people used to let out land in the time of the Messenger of Allah (ﷺ) for what grew by the current of water and at the banks of streamlets and at the places of cultivation. So sometimes this (portion) perished and that (portion) was saved, and sometimes this remained intact and that perished. There was no (form of) lease among the people except this. Therefore, he forbade it. But if there is something which is secure and known, then there is no harm in it. The tradition of Ibrahim is more perfect. Qutaibah said: "from Hanzalah on the authority of Rafi' ". Abu Dawud said: A similar tradition has been transmitted by Yahya b. Sa'id from Hanzalah

حنظلہ بن قیس انصاری کہتے ہیں میں نے رافع بن خدیج رضی اللہ عنہ سے سونے چاندی کے بدلے زمین کرایہ پر دینے کے بارے میں پوچھا تو انہوں نے کہا: اس میں کوئی مضائقہ نہیں، لوگ رسول اللہ صلی اللہ علیہ وسلم کے زمانہ میں اجرت پر لینے دینے کا معاملہ کرتے تھے پانی کی نالیوں، نالوں کے سروں اور کھیتی کی جگہوں کے بدلے ( یعنی ان جگہوں کی پیداوار میں لوں گا ) تو کبھی یہ برباد ہو جاتا اور وہ محفوظ رہتا اور کبھی یہ محفوظ رہتا اور وہ برباد ہو جاتا، اس کے سوا کرایہ کا اور کوئی طریقہ رائج نہ تھا اس لیے رسول اللہ صلی اللہ علیہ وسلم نے اس سے منع فرما دیا، اور رہی محفوظ اور مامون صورت تو اس میں کوئی حرج نہیں۔ ابراہیم کی حدیث مکمل ہے اور قتیبہ نے «عن حنظلة عن رافع» کہا ہے۔ ابوداؤد کہتے ہیں: یحییٰ بن سعید کی روایت جسے انہوں نے حنظلہ سے روایت کیا ہے اسی طرح ہے۔
