كتاب الطلاق
Tawus a dit : Un homme appelé Abu Al Sahba interrogeait souvent Ibn ‘Abbas رضي الله عنه. Il lui demanda : « Sais-tu que lorsqu’un homme divorçait de sa femme par trois prononcés avant d’avoir des rapports avec elle, on considérait cela comme un seul divorce à l’époque du Messager d’Allah ﷺ, d’Abu Bakr et au début du califat de ‘Umar ? » Ibn ‘Abbas رضي الله عنه répondit : « Oui, lorsqu’un homme divorçait de sa femme par trois prononcés avant d’avoir des rapports, on considérait cela comme un seul divorce à l’époque du Messager d’Allah ﷺ, d’Abu Bakr et au début du califat de ‘Umar. Quand ‘Umar vit que les gens abusaient du divorce (par trois prononcés), il dit : “Faites-les appliquer sur eux (c’est-à-dire sur les femmes).” »

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ، حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ غَيْرِ، وَاحِدٍ، عَنْ طَاوُسٍ، أَنَّ رَجُلاً، يُقَالُ لَهُ أَبُو الصَّهْبَاءِ كَانَ كَثِيرَ السُّؤَالِ لاِبْنِ عَبَّاسٍ قَالَ أَمَا عَلِمْتَ أَنَّ الرَّجُلَ كَانَ إِذَا طَلَّقَ امْرَأَتَهُ ثَلاَثًا قَبْلَ أَنْ يَدْخُلَ بِهَا جَعَلُوهَا وَاحِدَةً عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَأَبِي بَكْرٍ وَصَدْرًا مِنْ إِمَارَةِ عُمَرَ قَالَ ابْنُ عَبَّاسٍ بَلَى كَانَ الرَّجُلُ إِذَا طَلَّقَ امْرَأَتَهُ ثَلاَثًا قَبْلَ أَنْ يَدْخُلَ بِهَا جَعَلُوهَا وَاحِدَةً عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَأَبِي بَكْرٍ وَصَدْرًا مِنْ إِمَارَةِ عُمَرَ فَلَمَّا رَأَى النَّاسَ قَدْ تَتَابَعُوا فِيهَا قَالَ أَجِيزُوهُنَّ عَلَيْهِمْ .
Traduction anglaise
Tawus said A man called Abu Al Sahba used to ask Ibn ‘Abbas questions frequently. He asked “Do you know that when a man divorced his wife by three pronouncement before sexual intercourse with her, they (the people) made it a single divorce during the time of the Apostle of Allaah(ﷺ), of Abu Bakr and in the early phase of the caliphate of ‘Umar?” Ibn “Abbas said “Yes, when a man divorced his wife by three pronouncement before sexual intercourse they made it a single divorce during the time of the Apostle of Allaah(ﷺ), of Abu Bakr and in the early phase of the caliphate of ‘Umar. When he saw that the people frequently divorced (by three pronouncements) he said “Make them operative on them (i.e., on women)”

طاؤس سے روایت ہے کہ ایک صاحب جنہیں ابوصہبا کہا جاتا تھا ابن عباس رضی اللہ عنہما سے کثرت سے سوال کرتے تھے انہوں نے پوچھا: کیا آپ کو معلوم ہے کہ جب آدمی اپنی بیوی کو دخول سے پہلے ہی تین طلاق دے دیتا، تو رسول اللہ صلی اللہ علیہ وسلم اور ابوبکر رضی اللہ عنہ کے زمانے نیز عمر رضی اللہ عنہ کے ابتدائی دور خلافت میں اسے ایک طلاق مانا جاتا تھا؟ ابن عباس رضی اللہ عنہما نے جواب دیا: ہاں کیوں نہیں؟ جب آدمی اپنی بیوی کو دخول سے پہلے ہی تین طلاق دے دیتا تھا، تو اسے رسول اللہ صلی اللہ علیہ وسلم اور ابوبکر رضی اللہ عنہ کے زمانے میں نیز عمر رضی اللہ عنہ کے ابتدائی دور خلافت میں ایک ہی طلاق مانا جاتا تھا، لیکن جب عمر رضی اللہ عنہ نے دیکھا کہ لوگ بہت زیادہ ایسا کرنے لگے ہیں تو کہا کہ میں انہیں تین ہی نافذ کروں گا ۱؎۔
