Hadith 3512 — Livre 27: The Book of Divorce
كتاب الطلاق
Rapporté par Sulaiman bin Yasir : Abu Hurairah, Ibn 'Abbas et Abu Salamah bin 'Abdur-Rahman discutaient de la période de 'Idda d’une femme dont le mari meurt, et qui accouche après la mort de son mari. Ibn 'Abbas a dit : "Elle doit observer la plus longue des deux périodes." Abu Salamah a dit : "Non, elle peut se remarier dès qu’elle a accouché." Abu Hurairah a dit : "Je suis d’accord avec le fils de mon frère." Ils ont donc envoyé un message à Umm Salamah, l’épouse du Prophète ﷺ, et elle a dit : "Subai'ah Al-Aslamiyyah a accouché peu après la mort de son mari ; elle a consulté le Messager d’Allah ﷺ et il lui a dit de se remarier

أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ يَحْيَى، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ أَبَا هُرَيْرَةَ، وَابْنَ، عَبَّاسٍ وَأَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ تَذَاكَرُوا عِدَّةَ الْمُتَوَفَّى عَنْهَا زَوْجُهَا تَضَعُ عِنْدَ وَفَاةِ زَوْجِهَا فَقَالَ ابْنُ عَبَّاسٍ تَعْتَدُّ آخِرَ الأَجَلَيْنِ . وَقَالَ أَبُو سَلَمَةَ بَلْ تَحِلُّ حِينَ تَضَعُ . فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي . فَأَرْسَلُوا إِلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صلى الله عليه وسلم فَقَالَتْ وَضَعَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِيَسِيرٍ فَاسْتَفْتَتْ رَسُولَ اللَّهِ صلى الله عليه وسلم فَأَمَرَهَا أَنْ تَتَزَوَّجَ .
Traduction anglaise
It was narrated from Sulaiman bin Yasir that Abu Hurairah, Ibn 'Abbas, and Abu Salamah bin 'Abdur-Rahman were talking about the 'Iddah of a woman whose husband dies, and she gives birth after her husband dies. Ibn 'Abbas said:"She should observe 'Iddah for the longer of the two periods." Abu Salamah said: "No, it becomes permissible for her to marry when she has given birth." Abu Hurairah said: "I agree with my brother's son." So they sent word to Umm Salamah, the wife of the Prophet, and she said: "Subai'ah Al-Aslamiyyah gave birth shortly after her husband died; she consulted the Messenger of Allah and he told her to get married
Traduction en ourdou
سلیمان بن یسار سے روایت ہے، ابوہریرہ، ابن عباس (رضی الله عنہم) اور ابوسلمہ بن عبدالرحمٰن نے اس عورت کے بارے میں جس کا شوہر مر گیا ہو اور شوہر کے انتقال کے بعد بچہ جنا ہو آپس میں بات چیت کی۔ ابن عباس رضی اللہ عنہما نے کہا: جو عدت بعد میں پوری ہو اس کا وہ لحاظ و شمار کرے گی، ابوسلمہ نے کہا: نہیں وہ وضع حمل کے ساتھ ہی ( دوسرے کے لیے ) حلال ہو جائے گی، ابوہریرہ رضی اللہ عنہ نے کہا: میں بھی اپنے بھتیجے ابوسلمہ کے ساتھ ہوں ( یعنی ان کا ہم خیال ہوں ) ، پھر ان لوگوں نے ام المؤمنین ام سلمہ رضی اللہ عنہا کے پاس کسی کو بھیج کر معلوم کیا تو انہوں نے کہا: سبیعہ اسلمیہ رضی اللہ عنہا نے اپنے شوہر کے انتقال کے تھوڑے ہی دنوں بعد بچہ جنا پھر اس نے رسول اللہ صلی اللہ علیہ وسلم سے فتویٰ پوچھا تو آپ صلی اللہ علیہ وسلم نے اسے شادی کرنے کا حکم دیا۔
