Hadith 3488 — Livre 27: The Book of Divorce
كتاب الطلاق
Rapporté par Zaid bin Arqam : Trois hommes ont été amenés à ‘Ali alors qu’il était au Yémen ; ils avaient tous eu des rapports avec une femme pendant le même cycle menstruel. Il a demandé à deux d’entre eux : "Reconnaissez-vous que cet enfant appartient (au troisième homme) ?" Ils ont répondu : "Non." Il a demandé à deux autres : "Reconnaissez-vous que cet enfant appartient (au troisième homme) ?" Ils ont répondu : "Non." Alors il a tiré au sort entre eux, a attribué l’enfant à celui sur qui le sort est tombé, et l’a obligé à payer les deux tiers du diyah. Le Prophète en a été informé, et il a tellement ri que ses molaires étaient visibles

أَخْبَرَنَا أَبُو عَاصِمٍ، خُشَيْشُ بْنُ أَصْرَمَ قَالَ أَنْبَأَنَا عَبْدُ الرَّزَّاقِ، قَالَ أَنْبَأَنَا الثَّوْرِيُّ، عَنْ صَالِحٍ الْهَمْدَانِيِّ، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ خَيْرٍ، عَنْ زَيْدِ بْنِ أَرْقَمَ، قَالَ أُتِيَ عَلِيٌّ رضى الله عنه بِثَلاَثَةٍ وَهُوَ بِالْيَمَنِ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَسَأَلَ اثْنَيْنِ أَتُقِرَّانِ لِهَذَا بِالْوَلَدِ قَالاَ لاَ . ثُمَّ سَأَلَ اثْنَيْنِ أَتُقِرَّانِ لِهَذَا بِالْوَلَدِ قَالاَ لاَ . فَأَقْرَعَ بَيْنَهُمْ فَأَلْحَقَ الْوَلَدَ بِالَّذِي صَارَتْ عَلَيْهِ الْقُرْعَةُ وَجَعَلَ عَلَيْهِ ثُلُثَىِ الدِّيَةِ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ صلى الله عليه وسلم فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ .
Traduction anglaise
It was narrated that Zaid bin Arqam said:"Three men were brought to 'Ali while he was in Yemen; they all had intercourse with a woman during a single menstrual cycle. He asked two of them: 'Do you affirm that this child belongs to (the third man)?' And they said: 'No.' He asked another two of them: 'Do you affirm that this child belongs to (the third man)?' And they said: 'No.' So he cast lots between them, and attributed the child to the one whom the lot fell, and obliged him to pay two-thirds of the Diyah. The Prophet was told of this, and he laughed so much that his back teeth became visible

زید بن ارقم رضی الله عنہ کہتے ہیں کہ علی رضی اللہ عنہ جب یمن میں تھے ان کے پاس تین آدمی لائے گئے، ایک ہی طہر ( پاکی ) میں ان تینوں نے ایک عورت کے ساتھ جماع کیا تھا ( جھگڑا لڑکے کے تعلق سے تھا کہ ان تینوں میں سے کس کا ہے ) انہوں نے دو کو الگ کر کے پوچھا: کیا تم دونوں یہ لڑکا تیسرے کا تسلیم و قبول کرتے ہو، انہوں نے کہا: نہیں، پھر انہوں نے دو کو الگ کر کے تیسرے کے بارے میں پوچھا: کیا تم دونوں لڑکا اس کا مانتے ہو، انہوں نے کہا: نہیں، پھر انہوں نے ان تینوں کے نام کا قرعہ ڈالا اور جس کے نام پر قرعہ نکلا بچہ اسی کو دے دیا، اور دیت کا دو تہائی اس کے ذمہ کر دیا ( اور اس سے لے کر ایک ایک تہائی ان دونوں کو دے دیا ) ۱؎ یہ بات نبی اکرم صلی اللہ علیہ وسلم کے سامنے ذکر کی گئی تو آپ ہنس پڑے اور ایسے ہنسے کہ آپ کی داڑھ دکھائی دینے لگی ۲؎۔
