Hadith 3396 — Livre 27: The Book of Divorce
كتاب الطلاق
Rapporté par ‘Abdullah : Il a divorcé de sa femme alors qu’elle avait ses règles. ‘Umar est allé en informer le Prophète. Le Prophète lui a dit : “Dis à ‘Abdullah de la reprendre, puis, quand elle aura fait le Ghusl, qu’il la laisse, jusqu’à ce qu’elle ait de nouveau ses règles. Ensuite, quand elle aura fait le Ghusl après cette deuxième période, qu’il ne la touche pas jusqu’à ce qu’il la divorce. Et s’il veut la garder, qu’il la garde. C’est à ce moment-là qu’Allah a fixé que les femmes peuvent être divorcées.”

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الأَعْلَى، قَالَ حَدَّثَنَا الْمُعْتَمِرُ، قَالَ سَمِعْتُ عُبَيْدَ اللَّهِ بْنَ عُمَرَ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً فَانْطَلَقَ عُمَرُ فَأَخْبَرَ النَّبِيَّ صلى الله عليه وسلم بِذَلِكَ فَقَالَ لَهُ النَّبِيُّ صلى الله عليه وسلم " مُرْ عَبْدَ اللَّهِ فَلْيُرَاجِعْهَا فَإِذَا اغْتَسَلَتْ فَلْيَتْرُكْهَا حَتَّى تَحِيضَ فَإِذَا اغْتَسَلَتْ مِنْ حَيْضَتِهَا الأُخْرَى فَلاَ يَمَسَّهَا حَتَّى يُطَلِّقَهَا فَإِنْ شَاءَ أَنْ يُمْسِكَهَا فَلْيُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ " .
Traduction anglaise
It was narrated from 'Abdullah that he issued a divorce to his wife when she was menstruating. So 'Umar went to inform the Prophet about that. The Prophet said to him:"Tell 'Abdullah to take her back, then, when she has performed Ghusl, let him leave her alone, until she menstruates (again). Then, when she performs Ghusl following that second period, he should not touch her until he divorces her. And if he wants to keep her, then let him keep her. That is the time when Allah has stated that women may be divorced
Traduction en ourdou
عبداللہ بن عمر رضی الله عنہما سے روایت ہے کہ انہوں نے اپنی بیوی کو طلاق دے دی اور وہ حیض سے تھی۔ تو عمر رضی اللہ عنہ نبی اکرم صلی اللہ علیہ وسلم کے پاس گئے اور آپ کو اس بات کی خبر دی، تو نبی اکرم صلی اللہ علیہ وسلم نے ان سے کہا کہ عبداللہ کو حکم دو کہ اسے لوٹا لے۔ پھر جب ( حیض سے فارغ ہو کر ) وہ غسل کر لے تو اسے چھوڑے رکھے پھر جب حیض آئے اور اس دوسرے حیض سے فارغ ہو کر غسل کر لے تو اسے نہ چھوئے یعنی ( صحبت نہ کرے ) یہاں تک کہ اسے طلاق دیدے پھر اسے روک لینا چاہے تو روک لے ( اور طلاق نہ دے ) یہی وہ عدت ہے جس کا لحاظ کرتے ہوئے اللہ عزوجل نے عورتوں کو طلاق دینے کا حکم دیا ہے۔
