Hadith 3356 — Livre 26: The Book of Marriage
كتاب النكاح
Rapporté par ‘Abdullah : À propos d’un homme qui a épousé une femme, puis est décédé avant de consommer le mariage et sans fixer de dot : « Elle doit recevoir la dot, observer la ‘Iddah et elle peut hériter. » Ma’qil bin Sinan a dit : « J’ai entendu le Prophète ﷺ rendre le même jugement pour Birwa’ bint Washiq. »

أَخْبَرَنَا إِسْحَاقُ بْنُ مَنْصُورٍ، قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنْ فِرَاسٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ، فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا قَالَ لَهَا الصَّدَاقُ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ . فَقَالَ مَعْقِلُ بْنُ سِنَانٍ فَقَدْ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ .
Traduction anglaise
It was narrated that 'Abdullah said, concerning a man who married a woman, then died before consummating the marriage with her, and without naming a dowry:"She should have the dowry, and she has to observe the 'Iddah, and she may inherit." Ma'qil bin Sinan said: "I heard the Prophet pass the same judgment concerning Birwa' bint Washiq
Traduction en ourdou
عبداللہ بن مسعود رضی الله عنہ سے روایت ہے کہ ایک ایسا شخص جس نے ایک عورت سے شادی کی پھر مر گیا نہ اس سے خلوت کی تھی اور نہ ہی اس کا مہر مقرر کیا تھا۔ تو اس کے بارے میں انہوں نے فرمایا: اس عورت کا مہر ( مہر مثل ) ہو گا۔ اسے عدت گزارنی ہو گی اور اسے میراث ملے گی۔ ( یہ سن کر ) معقل بن سنان نے کہا: میں نے نبی اکرم صلی اللہ علیہ وسلم کو بروع بنت واشق کے معاملہ میں ایسا ہی فیصلہ کرتے سنا ہے۔
