Hadith 1198 — Livre 29: Divorce
كتاب الطلاق
Yahia Ibn Sa'id a rapporté que Mouhammad Ibn Yahia Ibn Habban a dit: «Mon grand-père Habban avait deux femmes: une Hachémite et une Ansarienne, il divorca de l'Ansarienne alors qu'elle nourrissait encore son petit. Une année se termina, et cette femme n'eut pas ses menstrues, puis l'homme mourut. Elle dit: «Moi j'ai droit à l'héritage, du moment que je n'ai pas eu mes menstrues», les deux femmes se disputèrent puis allèrent rapporter la question à Osman Ibn Affan. Ayant donné le droit d'héritage à l'Ansarienne, la Hachémite blâma Osman qui dit: «Telle était la décision prise par ton cousin, qui lui, nous l'a imposée», désignant par le cousin, Ali Ibn Abi-Taleb». وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، قَالَ كَانَتْ عِنْدَ جَدِّي حَبَّانَ امْرَأَتَانِ هَاشِمِيَّةٌ وَأَنْصَارِيَّةٌ فَطَلَّقَ الأَنْصَارِيَّةَ وَهِيَ تُرْضِعُ فَمَرَّتْ بِهَا سَنَةٌ ثُمَّ هَلَكَ عَنْهَا وَلَمْ تَحِضْ فَقَالَتْ أَنَا أَرِثُهُ لَمْ أَحِضْ فَاخْتَصَمَتَا إِلَى عُثْمَانَ بْنِ عَفَّانَ فَقَضَى لَهَا بِالْمِيرَاثِ فَلاَمَتِ الْهَاشِمِيَّةُ عُثْمَانَ فَقَالَ هَذَا عَمَلُ ابْنِ عَمِّكِ هُوَ أَشَارَ عَلَيْنَا بِهَذَا يَعْنِي عَلِيَّ بْنَ أَبِي طَالِبٍ .
Traduction anglaise
Yahya related to me from Malik from Yahya ibn Said that Muhammad ibn Yahya ibn Habban said, "My grandfather Habban had two wives, one from the Hashimites and one from the Ansars. He divorced the Ansariyya while she was nursing, and a year passed and he died and she had still not yet menstruated. She said, 'I inherit from him. I have not menstruated yet.' The wives quarrelled and went to Uthman ibn Affan. He decided that she did inherit, and the Hashimiyya rebuked Uthman. He said, 'This is the practice of the son of your paternal uncle. He pointed this out to us.' He meant Ali ibn Abi Talib
Traduction en ourdou
محمد بن یحیی بن حبان سے روایت ہے کہ میرے دادا حبان بن منقذ کے پاس دو بیبیاں تھیں ایک ہاشمی اور ایک انصاری۔ انصاری کو انہوں نے طلاق دی اور وہ ایک برس تک دودھ پلایا کرتی تھیں اس کو حیض نہ آیا اس کے بعد حبان مر گئے وہ بولی میں ترکہ لوں گی کیونکہ مجھے حیض نہیں آیا اور میری عدت نہیں گزری جب حضرت عثمان کے پاس یہ مقدمہ پیش ہوا تو انہوں نے ترکہ دلانے کا حکم کیا ہاشمی عورت حضرت عثمان کو برا کہنے لگی انہوں نے کہا یہ حکم تو تیرے چچا کے بیٹے کا ہے انہوں نے مجھ سے ایسا ہی کہا تھا یعنی حضرت علی کا ۔
