Hadith 1160 — Livre 29: Divorce
كتاب الطلاق
Nafe' a rapporté que Abdallah Ibn Omar disait: «Une fois qu'un homme charge sa femme du divorce, le sort en sera tel qu'elle le décide, sauf si l'homme ne le désavoue en disant: «Je ne l'ai chargée du divorce que pour une seule fois, en jurant à ce fait, et dans ce cas il pourra la reprendre, tant qu'elle est dans sa période d'attente». Chapitre IV Du divorce fait pour une fois quand ce droit est accordé à la femme

Texte arabe original
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ، كَانَ يَقُولُ إِذَا مَلَّكَ الرَّجُلُ امْرَأَتَهُ أَمْرَهَا فَالْقَضَاءُ مَا قَضَتْ بِهِ إِلاَّ أَنْ يُنْكِرَ عَلَيْهَا وَيَقُولَ لَمْ أُرِدْ إِلاَّ وَاحِدَةً فَيَحْلِفُ عَلَى ذَلِكَ وَيَكُونُ أَمْلَكَ بِهَا مَا كَانَتْ فِي عِدَّتِهَا .
Traduction anglaise
Yahya related to me from Malik from Nafi that Abdullah ibn Umar said, "When a man gives a woman command over herself, then the result is as she decides unless he denies it and says that he only meant to give her one divorce and he swears to it - then he has access to her while she is in her idda
Traduction en ourdou
نافع سے روایت ہے کہ عبداللہ بن عمر کہتے تھے جب مرد اپنی عورت کو طلاق کا مالک کر دے تو جب بھی طلاق عورت چاہے اپنے اوپر ڈال لے مگر جب خاوند انکار کرے اور کہے میں نے ایک طلاق کا اختیار دیا تھا اور حلف کرے تو اس عورت کامستحق ہوگا جب تک وہ عدت میں ہے ۔
