Hadith 3790 — Livre 20: The Book of Emancipating Slaves
كتاب العتق
Rapporté par Jabir b. Abdullah رضي الله عنه : Le Messager d’Allah ﷺ a rendu obligatoire à chaque tribu le paiement du prix du sang (diyya) ; il a aussi précisé qu’il n’est pas permis à un musulman de se faire l’allié (du serviteur affranchi par un autre) musulman sans sa permission. (Le rapporteur ajoute :) J’ai appris qu’il (le Prophète ﷺ) a maudit celui qui fait cela (et cela a été consigné) dans son écrit (sahifa)

وَحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ، يَقُولُ كَتَبَ النَّبِيُّ صلى الله عليه وسلم عَلَى كُلِّ بَطْنٍ عُقُولَهُ ثُمَّ كَتَبَ " أَنَّهُ لاَ يَحِلُّ لِمُسْلِمٍ أَنْ يَتَوَالَى مَوْلَى رَجُلٍ مُسْلِمٍ بِغَيْرِ إِذْنِهِ " . ثُمَّ أُخْبِرْتُ أَنَّهُ لَعَنَ فِي صَحِيفَتِهِ مَنْ فَعَلَ ذَلِكَ .
Traduction anglaise
Jabir b. Abdullah (Allah be pleased with them) reported that Allah's Apostle (ﷺ) made it obligatory for every tribe (the payment) of blood-wit; he then also made it explicit that it is not permissible for a Muslim to make himself the ally (of the slave emancipated by another) Muslim without his permission. He (the narrator further added):I was informed that he (the Holy Prophet) cursed the one who did that (and it was recorded) in his Sahifa (in a document)

حضرت جابر بن عبداللہ رضی اللہ عنہ کہتے ہیں : نبی صلی اللہ علیہ وسلم نے ( میثاقِ مدینہ میں ) دیتوں ( عقول ) کی ادائیگی قبیلے کی ہر شاخ پر لازم ٹھہرائی ، پھر آپ نے لکھا : " کسی مسلمان کے لیے جائز نہیں کہ کسی ( اور ) مسلمان کی اجازت کے بغیر اس کے ( مولیٰ ) غلام کو اپنا مولیٰ ( حقِ ولاء رکھنے والا ) بنا لے ۔ " پھر مجھے خبر دی گئی کہ آپ نے ، اپنے صحیفے میں ، اس شخص پر جو یہ کام کرے ، لعنت بھیجی
