Hadith 3710 — Livre 18: The Book of Divorce
كتاب الطلاق
Rapporté par Abu Ishaq : J’étais avec al-Aswad ibn Yazid assis dans la grande mosquée, et avec nous se trouvait al-Sha'bi, qui a raconté le récit de Fatima bint Qais رضي الله عنها selon lequel le Messager d’Allah ﷺ ne lui avait pas accordé de logement ni de pension. Al-Aswad a alors pris des cailloux dans sa main et les a lancés vers lui en disant : « Malheur à toi, tu racontes cela alors qu’Omar a dit : “Nous ne pouvons pas délaisser le Livre d’Allah et la Sunna de notre Prophète ﷺ pour les paroles d’une femme. Nous ne savons pas si elle s’en souvient ou si elle a oublié. Pour elle, il y a un logement et une pension. Allah, le Très-Haut, a dit : ‘Ne les chassez pas de leurs maisons et qu’elles ne partent pas elles-mêmes, sauf si elles commettent une faute grave’ (sourate 65, verset 1).” »

وَحَدَّثَنَاهُ مُحَمَّدُ بْنُ عَمْرِو بْنِ جَبَلَةَ، حَدَّثَنَا أَبُو أَحْمَدَ، حَدَّثَنَا عَمَّارُ بْنُ رُزَيْقٍ، عَنْ أَبِي إِسْحَاقَ، قَالَ كُنْتُ مَعَ الأَسْوَدِ بْنِ يَزِيدَ جَالِسًا فِي الْمَسْجِدِ الأَعْظَمِ وَمَعَنَا الشَّعْبِيُّ فَحَدَّثَ الشَّعْبِيُّ بِحَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمْ يَجْعَلْ لَهَا سُكْنَى وَلاَ نَفَقَةً ثُمَّ أَخَذَ الأَسْوَدُ كَفًّا مِنْ حَصًى فَحَصَبَهُ بِهِ . فَقَالَ وَيْلَكَ تُحَدِّثُ بِمِثْلِ هَذَا قَالَ عُمَرُ لاَ نَتْرُكُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّنَا صلى الله عليه وسلم لِقَوْلِ امْرَأَةٍ لاَ نَدْرِي لَعَلَّهَا حَفِظَتْ أَوْ نَسِيَتْ لَهَا السُّكْنَى وَالنَّفَقَةُ قَالَ اللَّهُ عَزَّ وَجَلَّ { لاَ تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلاَ يَخْرُجْنَ إِلاَّ أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} .
Traduction anglaise
Abu Ishaq reported:I was with al-Aswad b. Yazid sitting in the great mosque, and there was with us al-Sha'bi, and he narrated the narration of Fatima bint Qais (Allah be pleased with her) that Allah's Messenger (ﷺ) did not make any provision for lodging and maintenance allowance for her. Al-Aswad caught hold of some pebbles in his fist and he threw them towards him saying: Woe be to thee, you narrate like it, whereas Umar said: We cannot abandon the Book of Allah and the Sunnah of our Apostle (ﷺ) for the words of a woman. We do not know whether she remembers that or she forgets. For her, there is a provision of lodging and maintenance allowance. Allah, the Exalted and Majestic, said:" Turn them not from their houses nor should they themselves go forth unless they commit an open indecency" (lxv)
Traduction en ourdou
ابواحمد نے ہمیں خبر دی ، ( کہا : ) عمار بن رزیق نے ہمیں ابواسحاق سے حدیث بیان کی ، انہوں نے کہا : میں اسود بن یزید ( نخعی ) کے ساتھ ( کوفہ کی ) بڑی مسجد میں بیٹھا ہوا تھا ، شعبی بھی ہمارے ساتھ تھے ، تو شعبی نے فاطمہ بنت قیس رضی اللہ عنہا کی حدیث بیان کی کہ رسول اللہ صلی اللہ علیہ وسلم نے انہیں رہائش اور خرچ ( کا حق ) نہیں دیا ۔ پھر اسود نے مٹھی بھر کنکریاں لیں اور انہیں دے ماریں اور کہا : تم پر افسوس! تم اس طرح کی حدیث بیان کر رہے ہو؟ عمر رضی اللہ عنہ نے کہا تھا : ہم ایک عورت کے قول کی وجہ سے اللہ کی کتاب اور اس کے رسول کی سنت کو نہیں چھوڑ سکتے ، ہم نہیں جانتے کہ اس نے ( اس مسئلے کو ) یاد رکھا ہے یا بھول گئی ، اس کے لیے رہائش اور خرچ ہے ۔ ( اور یہ آیت تلاوت کی ) اللہ عزوجل نے فرمایا : " تم انہیں ان کے گھروں سے نہ نکالو ، اور نہ وہ خود نکلیں ، مگر یہ کہ وہ کوئی کھلی بے حیائی کریں
