Hadith 3656 — Livre 18: The Book of Divorce
كتاب الطلاق
Rapporté par Ibn ‘Umar رضي الله عنه : Il a divorcé de sa femme pendant ses règles. ‘Umar رضي الله عنه a interrogé le Messager d’Allah ﷺ, qui lui a ordonné (‘Abdullah b. ‘Umar) de la reprendre, puis de patienter jusqu’à ce qu’elle ait ses deuxièmes règles, puis de patienter jusqu’à ce qu’elle soit purifiée, puis de la divorcer définitivement avant d’avoir eu de rapports avec elle, car c’est la période prescrite qu’Allah a ordonnée pour le divorce des femmes. Lorsque Ibn ‘Umar رضي الله عنه a été interrogé sur la personne qui divorce de sa femme pendant ses règles, il a dit : « Si tu as prononcé un ou deux divorces, le Messager d’Allah ﷺ lui a ordonné de la reprendre, puis de patienter jusqu’à ce qu’elle ait ses deuxièmes règles, puis de patienter jusqu’à ce qu’elle soit purifiée, puis de la divorcer définitivement avant d’avoir eu de rapports avec elle ; et si tu as prononcé trois divorces d’un coup, tu as désobéi à ton Seigneur concernant ce qu’Il t’a ordonné pour le divorce de ta femme. Mais elle est tout de même séparée de toi. »

وَحَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا إِسْمَاعِيلُ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، أَنَّ ابْنَ عُمَرَ، طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ صلى الله عليه وسلم فَأَمَرَهُ أَنْ يَرْجِعَهَا ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ . قَالَ فَكَانَ ابْنُ عُمَرَ إِذَا سُئِلَ عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهْىَ حَائِضٌ يَقُولُ أَمَّا أَنْتَ طَلَّقْتَهَا وَاحِدَةً أَوِ اثْنَتَيْنِ . إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أَمَرَهُ أَنْ يَرْجِعَهَا ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا وَأَمَّا أَنْتَ طَلَّقْتَهَا ثَلاَثًا فَقَدْ عَصَيْتَ رَبَّكَ فِيمَا أَمَرَكَ بِهِ مِنْ طَلاَقِ امْرَأَتِكَ . وَبَانَتْ مِنْكَ .
Traduction anglaise
Ibn 'Umar (Allah be pleased with them) reported that he divorced his wife during the period of menses. 'Umar (Allah be, pleas'ed with him) asked Allah's Apostle (ﷺ), and he commanded him ('Abdullah b. 'Umar) to have her back and then allow her respite until she enters the period of the second menses, and then allow her respite until she is purified, then divorce her (finally) before touching her (having a sexual intercourse with her), for that is the prescribed period which Allah commanded (to be kept in view) for divorcing the women. When Ibn 'Umar (Allah be pleased with them) was asked about the person who divorces his wife in the state of menses, he said:If you pronounced one divorce or two, Allah's Messenger (ﷺ) had commanded him to take her back, and then allow her respite until she enters the period of the second menses, and then allow her respite until she is purified, and then divorce her (finally) before touching her (having a sexual intercourse with her) ; and if you have pronounced (three divorces at one and the same time) you have in fact disobeyed your Lord with regard to what He commanded you about divorcing your wife. But she is however (finally separated from you)
Traduction en ourdou
ایوب نے نافع سے روایت کی کہ حضرت ابن عمر رضی اللہ عنہ نے اپنی بیوی کو حیض کی حالت میں طلاق دے دی ۔ حضرت عمر رضی اللہ عنہ نے ( اس کے بارے میں ) نبی صلی اللہ علیہ وسلم سے سوال کیا ، تو آپ نے انہیں حکم دیا کہ وہ ( ابن عمر رضی اللہ عنہ ) اس عورت سے رجوع کرے ، پھر اسے مہلت دے حتی کہ اسے دوسرا حیض آئے ، پھر اسے مہلت دے حتی کہ وہ پاک ہو جائے ، پھر اسے چھونے ( مجامعت کرنے ) سے پہلے طلاق دے ، یہی وہ عدت ہے جس کا اللہ تعالیٰ نے حکم دیا ہے کہ اس کے مطابق عورتوں کو طلاق دی جائے ۔ ( نافع نے ) کہا : حضرت ابن عمر رضی اللہ عنہ سے جب اس آدمی کے بارے میں پوچھا جاتا جو اپنی بیوی کو حالت حیض میں طلاق دے دیتا ہے تو وہ کہتے : اگر تم نے ایک یا دو طلاقیں دی ہیں ( تو رجوع کر سکتے ہو کیو کہ ) رسول اللہ صلی اللہ علیہ وسلم نے انہیں حکم دیا تھا کہ اس سے رجوع کریں ، پھر اسے مہلت دیں حتی کہ اسے دوسرا حیض آئے ، ( فرمایا : ) پھر اسے مہلت دیں حتی کہ وہ پاک ہو جائے ، پھر اس سے مجامعت کرنے سے پہلے اسے طلاق دیں ۔ اور اگر تم نے تین طلاقیں دی ہیں تو تم نے اپنے رب کے حکم میں جو اس نے تمہاری بیوی کی طلاق کے حوالے سے تمہیں دیا ہے ، اس کی نافرمانی کی ہے اور ( اب ) وہ تم سے ( مستقل طور پر ) جدا ہو گئی ہے
