Hadith 3652 — Livre 18: The Book of Divorce
كتاب الطلاق
Rapporté par Ibn ‘Umar رضي الله عنه : Il a divorcé de sa femme alors qu’elle avait ses règles, du vivant du Messager d’Allah ﷺ. ‘Umar b. Khattab رضي الله عنه a interrogé le Messager d’Allah ﷺ à ce sujet, et le Messager d’Allah ﷺ a dit : « Ordonne-lui (‘Abdullah b. ‘Umar) de la reprendre (et de la garder), puis de prononcer le divorce quand elle sera purifiée, puis qu’elle ait de nouveau ses règles, puis qu’elle soit encore purifiée ; alors, s’il le souhaite, il peut la garder, ou bien la divorcer définitivement avant d’avoir eu de rapports avec elle, car c’est la période d’attente (‘idda) qu’Allah, le Très-Haut, a prescrite pour le divorce des femmes. »

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى التَّمِيمِيُّ، قَالَ قَرَأْتُ عَلَى مَالِكِ بْنِ أَنَسٍ عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ ذَلِكَ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم " مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيَتْرُكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ" .
Traduction anglaise
Ibn 'Umar (Allah be pleased with them) reported that he divorced his wife while she was menstruating during the lifetime of Allah's Messenger (ﷺ). 'Umar b. Khattib (Allah be pleased with him) asked Allah's Messenger (ﷺ) about it, whereupon Allah's Messenger (ﷺ) said:Command him ('Abdullah b. 'Umar) to take her back (and keep her) and pronounce divorce when she is purified and she again enters the period of menstruation and she is again purified (after passing the period of menses), and then if he so desires he may keep her and if he desires divorce her (finally) before touching her (without having an intercourse with her), for that is the period of waiting ('ldda) which God, the Exalted and Glorious, has commanded for the divorce of women

امام مالک بن انس نے نافع سے ، انہوں نے حضرت ابن عمر رضی اللہ عنہ سے روایت کی کہ انہوں نے رسول اللہ صلی اللہ علیہ وسلم کے عہد میں اپنی بیوی کو جبکہ وہ حائضہ تھی ، طلاق دے دی ، حضرت عمر بن خطاب رضی اللہ عنہ نے اس کے بارے میں رسول اللہ صلی اللہ علیہ وسلم سے پوچھا تو رسول اللہ صلی اللہ علیہ وسلم نے ان سے فرمایا : " اسے حکم دو کہ وہ اس سے رجوع کرے ، پھر اسے رہنے دے حتی کہ وہ پاک ہو جائے ( طہر شروع ہو جائے ) ، پھر اسے حیض آ جائے ، پھر وہ پاک ہو جائے ۔ پھر اگر وہ چاہے تو اس کے بعد اسے اپنے پاس رکھے اور اگر چاہے تو اس سے مجامعت کرنے سے پہلے طلاق دے دے ۔ یہی وہ عدت ہے جس کا اللہ نے حکم دیا ہے کہ اس کے مطابق عورتوں کو طلاق دی جائے
