Hadith 2696 — Livre 22: The Chapters on Wills
كتاب الوصايا
Rapporté par Malik bin Mighwal, d’après Talhah bin Musarrif : “J’ai demandé à Abdullah bin Abu Awfa : ‘Le Messager d’Allah (ﷺ) a-t-il fait un testament ?’ Il a répondu : ‘Non.’ J’ai dit : ‘Comment se fait-il qu’il ait ordonné aux musulmans de faire des testaments ?’ Il a dit : ‘Il leur a recommandé de suivre le Livre d’Allah (SWT).’ Malik a dit : ‘Talhah bin Musarrif a rapporté que Huzail bin Shurahbil a dit : “Abu Bakr a-t-il reçu le pouvoir selon le testament du Messager d’Allah (ﷺ) ?” (En réalité) Abu Bakr aurait souhaité trouver un engagement écrit du Messager d’Allah (ﷺ), afin de pouvoir s’y tenir fermement.’”

حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا وَكِيعٌ، عَنْ مَالِكِ بْنِ مِغْوَلٍ، عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ، قَالَ قُلْتُ لِعَبْدِ اللَّهِ بْنِ أَبِي أَوْفَى أَوْصَى رَسُولُ اللَّهِ صلى الله عليه وسلم بِشَىْءٍ قَالَ لاَ . قُلْتُ فَكَيْفَ أَمَرَ الْمُسْلِمِينَ بِالْوَصِيَّةِ قَالَ أَوْصَى بِكِتَابِ اللَّهِ . قَالَ مَالِكٌ وَقَالَ طَلْحَةُ بْنُ مُصَرِّفٍ قَالَ الْهُزَيْلُ بْنُ شُرَحْبِيلَ أَبُو بَكْرٍ كَانَ يَتَأَمَّرُ عَلَى وَصِيِّ رَسُولِ اللَّهِ صلى الله عليه وسلم وَدَّ أَبُو بَكْرٍ أَنَّهُ وَجَدَ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم عَهْدًا فَخَزَمَ أَنْفَهُ بِخِزَامٍ .
Traduction anglaise
It was narrated from Malik bin Mighwal that Talhah bin Musarrif said:“I said to Abdullah bin Abu Awfa: 'Did the Messenger of Allah (ﷺ) make a will concerning anything?' He said: 'No.' I said: 'How come he told the Muslims to make wills?' He said: 'He enjoined (them to adhere to) the book of Allah (SWT).” Malik said: “Talhah bin Musarrif said: 'Huzail bin Shurahbil said: “Abu Bakr was granted leadership according to the will of Allah's Messenger (ﷺ)?” (Rather) Abu Bakr wished that the found a covenant (in that regard) from Allah's Messenger (ﷺ), so he could fetter his nose with a (camel's) nose ring.”
Traduction en ourdou
طلحہ بن مصرف کہتے ہیں کہ میں نے عبداللہ بن ابی اوفی رضی اللہ عنہ سے پوچھا: کیا رسول اللہ صلی اللہ علیہ وسلم نے کسی چیز کی وصیت کی ہے؟ انہوں نے جواب دیا: نہیں، میں نے کہا: پھر کیوں کر مسلمانوں کو وصیت کا حکم دیا؟ تو انہوں نے کہا: آپ صلی اللہ علیہ وسلم نے اللہ کی کتاب ( قرآن ) پر چلنے کی وصیت فرمائی ۱؎۔ مالک کہتے ہیں: طلحہ بن مصرف کا بیان ہے کہ ہزیل بن شرحبیل نے کہا: بھلا ابوبکر رضی اللہ عنہ رسول اللہ صلی اللہعلیہ وسلم کے وصی پر حکومت کر سکتے تھے؟ ابوبکر رضی اللہ عنہ کا تو یہ حال تھا کہ اگر وہ آپ صلی اللہ علیہ وسلم کا حکم پاتے تو تابع دار اونٹنی کی طرح اپنی ناک میں ( اطاعت کی ) نکیل ڈال لیتے۔
