Rapporté par 'Umar bin Khattab : Il a interrogé les gens sur la décision du Prophète (ﷺ) à ce sujet – à propos d’un fœtus. Hamal bin Malik bin Nabighah s’est levé et a dit : “J’étais entre mes deux femmes et l’une d’elles a frappé l’autre avec un piquet de tente, la tuant ainsi que le fœtus. Le Messager d’Allah (ﷺ) a jugé que la compensation pour le fœtus était un esclave, et qu’elle serait tuée en représailles.”

حَدَّثَنَا أَحْمَدُ بْنُ سَعِيدٍ الدَّارِمِيُّ، حَدَّثَنَا أَبُو عَاصِمٍ، أَخْبَرَنِي ابْنُ جُرَيْجٍ، حَدَّثَنِي عَمْرُو بْنُ دِينَارٍ، أَنَّهُ سَمِعَ طَاوُسًا، عَنِ ابْنِ عَبَّاسٍ، عَنْ عُمَرَ بْنِ الْخَطَّابِ، أَنَّهُ نَشَدَ النَّاسَ قَضَاءَ النَّبِيِّ صلى الله عليه وسلم فِي ذَلِكَ يَعْنِي فِي الْجَنِينِ فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ فَقَالَ كُنْتُ بَيْنَ امْرَأَتَيْنِ لِي فَضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَقَتَلَتْ جَنِينَهَا فَقَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم فِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ وَأَنْ تُقْتَلَ بِهَا .
Traduction anglaise
It was narrated from 'Umar bin Khattab that :he asked the people about the ruling of the Prophet (ﷺ) concerning that - concerning a fetus. Hamal bin Malik bin Nabighah stood up and said: “I was between my two wives and one of them struck the other with a tent-pole, killing her and a fetus. The Messenger of Allah (ﷺ) ruled that the blood money for the fetus was a slave, and that she would be killed in retaliation.”

عبداللہ بن عباس رضی اللہ عنہما کہتے ہیں کہ عمر رضی اللہ عنہ نے جنین ( پیٹ کے بچے ) کے بارے میں رسول اللہ صلی اللہ علیہ وسلم کا فرمان تلاش کیا، تو حمل بن مالک رضی اللہ عنہ نے کھڑے ہو کر کہا: میری دو بیویاں تھیں، ان میں سے ایک نے دوسری کو خیمے کی لکڑی سے مارا جس سے وہ اور اس کے پیٹ میں جو بچہ تھا دونوں مر گئے، پھر آپ صلی اللہ علیہ وسلم نے جنین ( پیٹ کے بچہ ) میں ایک غلام یا ایک لونڈی دینے کا، اور عورت کو عورت کے قصاص میں قتل کا فیصلہ فرمایا ۱؎۔
