Hadith 2626 — Livre 21: The Chapters on Blood Money

Rapporté par ‘Amr bin Shu’aib, d’après son père, d’après son grand-père : Le Messager d’Allah (ﷺ) a dit : “Celui qui tue délibérément sera remis aux héritiers de la victime. S’ils le veulent, ils peuvent le tuer, ou s’ils le veulent, ils peuvent accepter le prix du sang, qui est de trente Hiqqah, trente Jadha’ah et quarante Khalifah. C’est le prix du sang pour un meurtre volontaire. Tout ce qui est réglé par réconciliation leur appartient, et c’est un engagement ferme.”

حَدَّثَنَا مَحْمُودُ بْنُ خَالِدٍ الدِّمَشْقِيُّ، حَدَّثَنَا أَبِي، حَدَّثَنَا مُحَمَّدُ بْنُ رَاشِدٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ قَتَلَ عَمْدًا دُفِعَ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوا وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَذَلِكَ ثَلاَثُونَ حِقَّةً وَثَلاَثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ مَا صُولِحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ " .
Traduction anglaise
It was narrated from 'Amr bin Shu'aib, from this father, from his grandfather that the Messenger of Allah (ﷺ) said:“Whoever kills deliberately, he will be handed over to the heirs of the victim. If they want, they may kill him, or if they want, they may accept the blood money, which is thirty Hiqqah, thirty Jadha'ah and forty Khalifah. This is the blood money for deliberate slaying. Whatever is settled by reconciliation belongs to them, and that is a binding covenant.”
Traduction en ourdou
عبداللہ بن عمرو بن العاص رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جس نے قصداً کسی کو قتل کر دیا، تو قاتل کو مقتول کے وارثوں کے حوالہ کر دیا جائے گا، وہ چاہیں تو اسے قتل کر دیں، اور چاہیں تو دیت لے لیں، دیت ( خوں بہا ) میں تیس حقہ، تیس جذعہ اور چالیس حاملہ اونٹنیاں ہیں، قتل عمد کی دیت یہی ہے، اور باہمی صلح سے جو بھی طے پائے وہ مقتول کے ورثاء کو ملے گا، اور سخت دیت یہی ہے۔ ۱؎
