كتاب الحدود
Rapporté par Bara' bin Azib : Le Messager d’Allah (ﷺ) est passé près d’un Juif au visage noirci qui avait été fouetté. Il les a appelés et a dit : “Est-ce la punition pour l’adultère que vous trouvez dans votre Livre ?” Ils ont répondu : “Oui.” Puis il a appelé un de leurs savants et a dit : “Je t’adjure par Allah (SWT) qui a révélé la Tawrah (Torah) à Moussa ! Est-ce la punition pour l’adultère que vous trouvez dans votre Livre ?” Il a répondu : “Non ; si tu ne m’avais pas adjuré par Allah (SWT), je ne te l’aurais pas dit. La punition pour l’adultère que nous trouvons dans notre Livre est la lapidation, mais beaucoup de nos notables étaient lapidés (à cause de la fréquence de l’adultère parmi eux), alors si l’un de nos notables était pris, on le laissait partir ; mais si c’était un faible, on appliquait la punition. Nous avons dit : ‘Venez, trouvons une solution à appliquer aussi bien aux notables qu’aux faibles.’ Nous avons donc décidé de noircir le visage et de les fouetter, au lieu de la lapidation.” Le Prophète (ﷺ) a dit : “Ô Allah (SWT), je suis le premier à rétablir ton commandement qu’ils avaient abandonné”, puis il a ordonné que l’homme soit lapidé

حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ مَرَّ النَّبِيُّ بِيَهُودِيٍّ مُحَمَّمٍ مَجْلُودٍ فَدَعَاهُمْ فَقَالَ " هَكَذَا تَجِدُونَ فِي كِتَابِكُمْ حَدَّ الزَّانِي " . قَالُوا نَعَمْ . فَدَعَا رَجُلاً مِنْ عُلَمَائِهِمْ فَقَالَ " أَنْشُدُكَ بِاللَّهِ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي قَالَ لاَ وَلَوْلاَ أَنَّكَ نَشَدْتَنِي لَمْ أُخْبِرْكَ نَجِدُ حَدَّ الزَّانِي فِي كِتَابِنَا الرَّجْمَ وَلَكِنَّهُ كَثُرَ فِي أَشْرَافِنَا فَكُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَكُنَّا إِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ . فَقُلْنَا تَعَالَوْا فَلْنَجْتَمِعْ عَلَى شَىْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ فَاجْتَمَعْنَا عَلَى التَّحْمِيمِ وَالْجَلْدِ مَكَانَ الرَّجْمِ . فَقَالَ النَّبِيُّ صلى الله عليه وسلم اللَّهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمْرَكَ إِذْ أَمَاتُوهُ " . وَأَمَرَ بِهِ فَرُجِمَ .
Traduction anglaise
It was narrated that Bara' bin Azib said:“The Messenger of Allah (ﷺ) passed by a Jew with a blackened face who had been flogged. He called them and said: 'Is this the punishment for the adulterer that you find in your Book?' They said: 'Yes.' Then he called one of their scholars and said: 'I adjure you by Allah (SWT) Who sent down the Tawrah (Torah) to Musa! Is this the punishment for the adulterer that you find in your Book?' He said: 'No; if you had not adjured me by Allah (SWT), I would not have told you. The punishment for the adulterer that we find in our Book is stoning, but many of our nobles were being stoned (because of the prevalence of adultery among them), so if we caught one of our nobles (committing adultery), we would let him go; but if we caught one of the weak among us, we would carry out the punishment on him. We said: “Come, let us agree upon something that we may impose on both noble and weak alike.” So we agreed to blacken the face and whip them, instead of stoning.' The Prophet (ﷺ) 'O Allah (SWT), I am the first of those who revive your command which they had killed off,' and he issued orders that (the man) be stoned.”

براء بن عازب رضی اللہ عنہما کہتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم کا گزر ایک یہودی کے پاس سے ہوا جس کا منہ کالا کیا گیا تھا اور جس کو کوڑے لگائے گئے تھے، آپ صلی اللہ علیہ وسلم نے ان یہودیوں کو بلایا اور پوچھا: کیا تم لوگ اپنی کتاب توریت میں زانی کی یہی حد پاتے ہو ؟ لوگوں نے عرض کیا: ہاں، پھر آپ صلی اللہ علیہ وسلم نے ان کے عالموں میں سے ایک شخص کو بلایا، اور اس سے پوچھا: میں تمہیں اس اللہ کا واسطہ دے کر کہتا ہوں جس نے موسیٰ پر توراۃ نازل فرمائی: کیا تم اپنی کتاب میں زانی کی حد یہی پاتے ہو ؟ اس نے جواب دیا: نہیں، اور اگر آپ نے مجھے اللہ کی قسم نہ دی ہوتی تو میں آپ کو کبھی نہ بتاتا، ہماری کتاب میں زانی کی حد رجم ہے، لیکن ہمارے معزز لوگوں میں کثرت سے رجم کے واقعات پیش آئے، تو جب ہم کسی معزز آدمی کو زنا کے جرم میں پکڑتے تو اسے چھوڑ دیتے اور اگر پکڑا جانے والا معمولی آدمی ہوتا تو ہم اس پر حد جاری کرتے، پھر ہم نے لوگوں سے کہا کہ آؤ ایسی حد پر اتفاق کریں کہ جو معزز اور معمولی دونوں قسم کے آدمیوں پر ہم یکساں طور پر قائم کر سکیں، چنانچہ ہم نے رجم کی جگہ منہ کالا کرنے اور کوڑے مارنے کی سزا پر اتفاق کر لیا، یہ سن کر نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: «اللهم إني أول من أحيا أمرك إذ أماتوه» یعنی اے اللہ! میں پہلا وہ شخص ہوں جس نے تیرے اس حکم کو زندہ کیا ہے جسے ان لوگوں نے مردہ کر دیا تھا ، آپ صلی اللہ علیہ وسلم نے حکم دیا اور وہ یہودی رجم کر دیا گیا۔
