Rapporté par Ibn `Umar : Le Messager d’Allah (ﷺ) a dit : « Celui qui affranchit sa part d’un esclave, le prix de l’esclave doit être évalué équitablement, et il (le partenaire qui a commencé ce processus) doit l’affranchir complètement en versant le reste du prix aux autres copropriétaires, s’il en a les moyens. Sinon, il aura affranchi seulement la part qu’il a libérée. »

حَدَّثَنَا يَحْيَى بْنُ حَكِيمٍ، حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ بِقِيمَةِ عَدْلٍ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ إِنْ كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ " .
Traduction anglaise
It was narrated from Ibn`Umar that the Messenger of Allah (ﷺ) said:“Whoever frees his share of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price to the other co-owners), if he has enough wealth to do so. Otherwise, he will have freed whatever he freed.”
Traduction en ourdou
عبداللہ بن عمر رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص کسی غلام میں سے اپنے حصہ کو آزاد کر دے، تو کسی عادل شخص سے غلام کی قیمت لگوائی جائے گی، اور اس کے بقیہ شرکاء کے حصہ کی قیمت بھی اسے ادا کرنی ہو گی، بشرطیکہ اس کے پاس اس قدر مال ہو جتنی غلام کی قیمت ہے، اور اس طرح پورا غلام اس کی طرف سے آزاد ہو جائے گا، لیکن اگر اس کے پاس مال نہ ہو تو ایسی صورت میں بس اسی قدر غلام آزاد ہو گا جتنا اس نے آزاد کر دیا ۔
