كتاب الطلاق
Rapporté par Yunus bin Jubair, Abu Ghallab : J’ai demandé à Ibn 'Umar au sujet d’un homme qui a divorcé de sa femme alors qu’elle avait ses règles. Il a dit : "Connais-tu 'Abdullah bin 'Umar ? Il a divorcé de sa femme alors qu’elle avait ses règles, puis 'Umar est allé voir le Prophète ﷺ (et lui a raconté ce qui s’était passé). Il lui a ordonné de la reprendre." J’ai demandé : "Est-ce que cela compte (comme un divorce) ?" Il a dit : "Penses-tu qu’il était incapable et qu’il agissait bêtement ? [C’est-à-dire : Oui, cela compte comme un divorce]

حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْجَهْضَمِيُّ، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا هِشَامٌ، عَنْ مُحَمَّدٍ، عَنْ يُونُسَ بْنِ جُبَيْرٍ أَبِي غَلاَّبٍ، قَالَ سَأَلْتُ ابْنَ عُمَرَ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَأَمَرَهُ أَنْ يُرَاجِعَهَا . قُلْتُ أَيُعْتَدُّ بِتِلْكَ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ
Traduction anglaise
It was narrated that Yunus bin Jubair, Abu Ghallab, said:"I asked Ibn 'Umar about a man who divorced his wife when she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar? He divorced his wife when she was menstruating then 'Umar came to the Prophet (ﷺ) (and told him what had happened). He ordered him to take her back.' I said: 'Will that be counted (as a divorce)?' He said: 'Do You think he was helpless and behaving foolishly? [i.e., Yes, it counts (as a divorce]
Traduction en ourdou
ابو غلاب یونس بن جبیر کہتے ہیں کہ میں نے ابن عمر رضی اللہ عنہما سے اس شخص کے بارے میں پوچھا جس نے اپنی بیوی کو حیض کی حالت میں طلاق دے دی تو انہوں نے کہا: کیا تم عبداللہ بن عمر رضی اللہ عنہما کو پہچانتے ہو؟ انہوں نے اپنی بیوی کو حیض کی حالت میں طلاق دے دی تھی تو عمر رضی اللہ عنہ نبی اکرم صلی اللہ علیہ وسلم کے پاس آئے تو آپ صلی اللہ علیہ وسلم نے انہیں حکم دیا تھا کہ ابن عمر رجوع کر لیں، میں نے پوچھا: کیا اس طلاق کا شمار ہو گا؟ انہوں نے کہا: تم کیا سمجھتے ہو، اگر وہ عاجز ہو جائے یا دیوانہ ہو جائے ( تو کیا وہ شمار نہ ہو گی یعنی ضرور ہو گی ) ۔
