Rapporté par Abdullah ibn Abbas رضي الله عنه : Le Messager d’Allah ﷺ a jugé au sujet de l’esclave qui avait conclu un contrat pour acheter sa liberté (mukatab) et qui avait été tué, que le prix du sang devait être payé comme pour un homme libre, selon ce qu’il avait déjà payé, et comme pour un esclave pour le reste

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، وَحَدَّثَنَا إِسْمَاعِيلُ، عَنْ هِشَامٍ، وَحَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَعْلَى بْنُ عُبَيْدٍ، حَدَّثَنَا حَجَّاجٌ الصَّوَّافُ، جَمِيعًا عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم فِي دِيَةِ الْمُكَاتَبِ يُقْتَلُ يُودَى مَا أَدَّى مِنْ مُكَاتَبَتِهِ دِيَةَ الْحُرِّ وَمَا بَقِيَ دِيَةَ الْمَمْلُوكِ .
Traduction anglaise
Narrated Abdullah ibn Abbas: The Messenger of Allah (ﷺ) gave judgment about the slave who had made an agreement to purchase his freedom (mukatab) and he had been killed that blood-wit is paid for him at the rate paid for a free man so far as he has paid the purchase money, and at the rate paid for a slave as the remainder is concerned

عبداللہ بن عباس رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے مکاتب غلام جسے قتل کر دیا جائے کی دیت میں فیصلہ فرمایا کہ قتل کے وقت جس قدر وہ بدل کتابت ادا کر چکا ہے اتنے حصہ کی دیت آزاد کی دیت کے مثل ہو گی اور جس قدر ادائیگی باقی ہے اتنے حصے کی دیت غلام کی دیت کے مثل ہو گی۔
