Hadith 4526 — Livre 41: Types of Blood-Wit (Kitab Al-Diyat)

Rapporté par Abu Salamah ibn Abd al-Rahman et Sulaiman ibn Yasar, d’après certains hommes des Ansar : Le Prophète ﷺ s’adressa aux Juifs et commença par eux : « Cinquante d’entre vous doivent prêter serment. » Mais ils refusèrent de le faire. Il dit alors aux Ansar : « Apportez votre preuve. » Ils dirent : « Devons-nous prêter serment sans avoir vu, Messager d’Allah ? » Le Messager d’Allah ﷺ imposa alors le paiement du prix du sang aux Juifs, car la victime avait été retrouvée parmi eux

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، وَسُلَيْمَانَ بْنِ يَسَارٍ، عَنْ رِجَالٍ، مِنَ الأَنْصَارِ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ لِلْيَهُودِ وَبَدَأَ بِهِمْ " يَحْلِفُ مِنْكُمْ خَمْسُونَ رَجُلاً " . فَأَبَوْا فَقَالَ لِلأَنْصَارِ " اسْتَحِقُّوا " . قَالُوا نَحْلِفُ عَلَى الْغَيْبِ يَا رَسُولَ اللَّهِ فَجَعَلَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم دِيَةً عَلَى يَهُودَ لأَنَّهُ وُجِدَ بَيْنَ أَظْهُرِهِمْ .
Traduction anglaise
Narrated 'Abu Salamah b. 'Abd al-Rahman and Sulaiman b. Yasar: On the authority of some men of the Ansar : The Prophet (ﷺ) said to the Jews and started with them: Fifty of you should take the oaths. But they refused (to take the oaths). He then said to the Ansar: Prove your claim. They said: Do we take the oaths without seeing, Messenger of Allah? The Messenger of Allah (ﷺ) then imposed the blood-wit on the Jews because he (the slain) was found among them

انصار کے کچھ لوگوں سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے پہلے یہود سے کہا: تم میں سے پچاس لوگ قسم کھائیں تو انہوں نے انکار کیا، پھر رسول اللہ صلی اللہ علیہ وسلم نے انصار سے کہا: تم اپنا حق ثابت کرو انہوں نے کہا: اللہ کے رسول! ہم ایسی بات پر قسم کھائیں جسے ہم نے دیکھا نہیں ہے؟ چنانچہ رسول اللہ صلی اللہ علیہ وسلم نے ان کی دیت یہود سے دلوائی اس لیے کہ وہ انہیں کے درمیان پایا گیا تھا۔
