Hadith 4447 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)
كتاب الحدود
Al-Bara’ b. Azib رضي الله عنه a dit : Les gens passèrent devant le Messager d’Allah ﷺ avec un juif dont le visage était noirci au charbon et qu’on faisait tourner. Il les supplia par Allah et demanda : « Quelle est la peine prévue pour un fornicateur dans votre Livre sacré ? » (Le narrateur dit :) Ils le renvoyèrent à l’un d’eux. Le Prophète ﷺ le supplia par Allah et demanda : « Quelle est la peine pour la fornication dans votre Livre sacré ? » Il répondit : « La lapidation. Mais la fornication s’est répandue chez nos gens de haut rang, alors nous n’avons pas aimé qu’on laisse tranquille un notable et qu’on applique la punition à un plus humble. Nous l’avons donc suspendue pour nous. » Le Messager d’Allah ﷺ ordonna alors qu’il soit lapidé à mort. Puis il dit : « Ô Allah ! Je suis le premier à redonner vie à un ordre de Ton Livre qu’ils avaient abandonné. »

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، عَنِ الأَعْمَشِ، عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ مَرُّوا عَلَى رَسُولِ اللَّهِ صلى الله عليه وسلم بِيَهُودِيٍّ قَدْ حُمِّمَ وَجْهُهُ وَهُوَ يُطَافُ بِهِ فَنَاشَدَهُمْ مَا حَدُّ الزَّانِي فِي كِتَابِهِمْ قَالَ فَأَحَالُوهُ عَلَى رَجُلٍ مِنْهُمْ فَنَشَدَهُ النَّبِيُّ صلى الله عليه وسلم " مَا حَدُّ الزَّانِي فِي كِتَابِكُمْ " . فَقَالَ الرَّجْمُ وَلَكِنْ ظَهَرَ الزِّنَا فِي أَشْرَافِنَا فَكَرِهْنَا أَنْ يُتْرَكَ الشَّرِيفُ وَيُقَامَ عَلَى مَنْ دُونَهُ فَوَضَعْنَا هَذَا عَنَّا . فَأَمَرَ بِهِ رَسُولُ اللَّهِ صلى الله عليه وسلم فَرُجِمَ ثُمَّ قَالَ " اللَّهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا مَا أَمَاتُوا مِنْ كِتَابِكَ " .
Traduction anglaise
Al-Bara’ b. Azib said:The people passed by the Messenger of Allah (ﷺ) with a jew whose face blackened with charcoal and he was being taken around. He adjured them by Allah and asked: What is the prescribed punishment for a fornicator in your Divine book? He (the narrator) said: They referred him to a man of them. The Prophet (ﷺ) adjured him and asked: What is the punishment for a fornication in your Divine Book? He replied: Stoning. But fornication spread among our people of rank, so we disliked that a person of rank should be left alone and the punishment be inflicted on one who is lower in rank than him. So we suspended it for us. The Messenger of Allah (ﷺ) then commanded regarding him and he was stoned to death. He then said: O Allah! I am the first to give life to a command of Thy Book which they had killed

براء بن عازب رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم کے پاس سے لوگ ایک یہودی کو لے کر گزرے جس کو ہاتھ منہ کالا کر کے گھمایا جا رہا تھا، تو آپ صلی اللہ علیہ وسلم نے ان سے اللہ کا واسطہ دے کر پوچھا کہ ان کی کتاب میں زانی کی حد کیا ہے؟ ان لوگوں نے آپ کو اپنے میں سے ایک شخص کی طرف اشارہ کر کے پوچھنے کے لیے کہا تو نبی اکرم صلی اللہ علیہ وسلم نے اس سے اللہ کا واسطہ دے کر پوچھا کہ تمہاری کتاب میں زانی کی حد کیا ہے؟ تو اس نے کہا: رجم ہے، لیکن زنا کا جرم ہمارے معزز لوگوں میں عام ہو گیا، تو ہم نے یہ پسند نہیں کیا کہ معزز اور شریف آدمی کو چھوڑ دیا جائے اور جو ایسے نہ ہوں ان پر حد جاری کی جائے، تو ہم نے اس حکم ہی کو اپنے اوپر سے اٹھا لیا، چنانچہ رسول اللہ صلی اللہ علیہ وسلم نے اسے رجم کا حکم دیا تو وہ رجم کر دیا گیا، پھر آپ صلی اللہ علیہ وسلم نے فرمایا: اے اللہ! میں وہ پہلا شخص ہوں جس نے تیری کتاب میں سے اس حکم کو زندہ کیا ہے جس پر لوگوں نے عمل چھوڑ دیا تھا ۔
