Rapporté par Abu Hurayrah رضي الله عنه : Deux hommes se disputaient un bien et ont porté l’affaire devant le Saint Prophète ﷺ, mais aucun d’eux n’a pu apporter de preuve. Le Saint Prophète ﷺ a alors dit : « Tirez au sort pour le serment, qu’ils l’acceptent ou non. »

حَدَّثَنَا مُحَمَّدُ بْنُ مِنْهَالٍ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا ابْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنْ خِلاَسٍ، عَنْ أَبِي رَافِعٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلَيْنِ، اخْتَصَمَا فِي مَتَاعٍ إِلَى النَّبِيِّ صلى الله عليه وسلم لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَقَالَ النَّبِيُّ صلى الله عليه وسلم " اسْتَهِمَا عَلَى الْيَمِينِ مَا كَانَ أَحَبَّا ذَلِكَ أَوْ كَرِهَا " .
Traduction anglaise
Narrated AbuHurayrah: Two men disputed about some property and brought the case to the Holy Prophet (ﷺ), but neither of them could produce any proof. So the Holy Prophet (ﷺ) said: Cast lots about the oath whatever it may be, whether they like it or dislike it

ابوہریرہ رضی اللہ عنہ کہتے ہیں کہ دو آدمی ایک سامان کے متعلق نبی اکرم صلی اللہ علیہ وسلم کے پاس جھگڑا لے کر گئے اور دونوں میں سے کسی کے پاس کوئی گواہ نہیں تھا تو آپ صلی اللہ علیہ وسلم نے فرمایا: تم دونوں قسم پر قرعہ اندازی کرو ۱؎ خواہ تم اسے پسند کرو یا ناپسند ۔
