Hadith 3573 — Livre 25: The Office of the Judge (Kitab Al-Aqdiyah)

Rapporté par Buraydah ibn al-Hasib رضي الله عنه : Le Prophète ﷺ a dit : « Il y a trois types de juges : l’un ira au Paradis et deux iront en Enfer. Celui qui ira au Paradis est l’homme qui connaît la vérité et juge selon elle ; mais celui qui connaît la vérité et juge injustement ira en Enfer ; et celui qui juge les gens alors qu’il est ignorant ira aussi en Enfer. » Abu Dawud a dit : À ce sujet, c’est la tradition la plus authentique, c’est-à-dire celle d’Ibn Buraidah : « Les juges sont de trois types. »

حَدَّثَنَا مُحَمَّدُ بْنُ حَسَّانَ السَّمْتِيُّ، حَدَّثَنَا خَلَفُ بْنُ خَلِيفَةَ، عَنْ أَبِي هَاشِمٍ، عَنِ ابْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " الْقُضَاةُ ثَلاَثَةٌ وَاحِدٌ فِي الْجَنَّةِ وَاثْنَانِ فِي النَّارِ فَأَمَّا الَّذِي فِي الْجَنَّةِ فَرَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ وَرَجُلٌ عَرَفَ الْحَقَّ فَجَارَ فِي الْحُكْمِ فَهُوَ فِي النَّارِ وَرَجُلٌ قَضَى لِلنَّاسِ عَلَى جَهْلٍ فَهُوَ فِي النَّارِ " . قَالَ أَبُو دَاوُدَ وَهَذَا أَصَحُّ شَىْءٍ فِيهِ يَعْنِي حَدِيثَ ابْنِ بُرَيْدَةَ " الْقُضَاةُ ثَلاَثَةٌ " .
Traduction anglaise
Narrated Buraydah ibn al-Hasib: The Prophet (ﷺ) said: Judges are of three types, one of whom will go to Paradise and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgment accordingly; but a man who knows what is right and acts tyrannically in his judgment will go to Hell; and a man who gives judgment for people when he is ignorant will go to Hell. Abu Dawud said: On this subject this is the soundest tradition, that is, the tradition of Ibn Buraidah: Judges are of three types

بریدہ رضی اللہ عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: قاضی تین طرح کے ہوتے ہیں: ایک جنتی اور دو جہنمی، رہا جنتی تو وہ ایسا شخص ہو گا جس نے حق کو جانا اور اسی کے موافق فیصلہ کیا، اور وہ شخص جس نے حق کو جانا اور اپنے فیصلے میں ظلم کیا تو وہ جہنمی ہے ۔ اور وہ شخص جس نے نادانی سے لوگوں کا فیصلہ کیا وہ بھی جہنمی ہے ۔ ابوداؤد کہتے ہیں: یہ یعنی ابن بریدہ کی تین قاضیوں والی حدیث اس باب میں سب سے صحیح روایت ہے۔
