Rapporté par Jabir ibn ‘Abdullah : Le Messager d’Allah ﷺ a établi le droit d’acheter le bien voisin pour tout ce qui n’est pas encore séparé, mais quand les limites sont fixées et que des chemins distincts sont tracés, il n’y a plus d’option

حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ إِنَّمَا جَعَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم الشُّفْعَةَ فِي كُلِّ مَالٍ لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِفَتِ الطُّرُقُ فَلاَ شُفْعَةَ .
Traduction anglaise
Narrated Jabir bin ‘Abdullah :The Messenger of Allah (ﷺ) decreed the right to buy the neighboring property applicable to everything which is not divided, but when boundaries are fixed and separate roads made, there is no option

جابر بن عبداللہ رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے شفعہ ہر اس چیز میں رکھا ہے، جو تقسیم نہ ہوئی ہو، لیکن جب حد بندیاں ہو گئی ہوں، اور راستے الگ الگ نکا ل دئیے گئے ہوں تو اس میں شفعہ نہیں ہے۔
