Hadith 3504 — Livre 24: Wages (Kitab Al-Ijarah)
كتاب الإجارة
Rapporté par ‘Amr b. Suh’aib, d’après son père, d’après son grand-père ‘Abd Allah b. ‘Amr : Le Messager d’Allah ﷺ a dit : « Il n’est pas permis de combiner un prêt et une vente dans une même transaction, ni de poser deux conditions dans un même contrat, ni de tirer profit de ce qui n’est pas sous sa responsabilité, ni de vendre ce que l’on ne possède pas. »

حَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا إِسْمَاعِيلُ، عَنْ أَيُّوبَ، حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ، حَدَّثَنِي أَبِي، عَنْ أَبِيهِ، عَنْ أَبِيهِ، حَتَّى ذَكَرَ عَبْدَ اللَّهِ بْنَ عَمْرٍو قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ يَحِلُّ سَلَفٌ وَبَيْعٌ وَلاَ شَرْطَانِ فِي بَيْعٍ وَلاَ رِبْحُ مَا لَمْ تَضْمَنْ وَلاَ بَيْعُ مَا لَيْسَ عِنْدَكَ " .
Traduction anglaise
Narrated 'Amr b. Suh'aib: On his father's authority, said that his grandfather 'Abd Allah b. 'Amr reported the Messenger of Allah (ﷺ) as saying: The proviso of a loan combined with a sale is not allowable, nor two conditions relating to one transaction, nor profit arising from something which is not in one's charge, nor selling what is not in your possession
Traduction en ourdou
عبداللہ بن عمرو رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ادھار اور بیع ایک ساتھ جائز نہیں ۱؎ اور نہ ہی ایک بیع میں دو شرطیں درست ہیں ۲؎ اور نہ اس چیز کا نفع لینا درست ہے، جس کا وہ ابھی ضامن نہ ہوا ہو، اور نہ اس چیز کی بیع درست ہے جو سرے سے تمہارے پاس ہو ہی نہیں ۳؎ ( کیونکہ چیز کے سامنے آنے کے بعد اختلاف اور جھگڑا پیدا ہو سکتا ہے ) ۔
