Hadith 3402 — Livre 23: Commercial Transactions (Kitab Al-Buyu)

Rapporté par Rafi’ ibn Khadij : Rafi’ avait cultivé une terre. Le Prophète ﷺ est passé près de lui alors qu’il l’arrosait. Il lui a demandé : « À qui appartiennent la récolte et la terre ? » Il a répondu : « La récolte est à moi, car j’ai fourni la semence et le travail. La moitié est pour moi et l’autre moitié pour untel. » Il a dit : « Tu as fait une transaction usuraire. Rends la terre à son propriétaire et prends ton salaire et tes dépenses. »

حَدَّثَنَا هَارُونُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا الْفَضْلُ بْنُ دُكَيْنٍ، حَدَّثَنَا بُكَيْرٌ، - يَعْنِي ابْنَ عَامِرٍ - عَنِ ابْنِ أَبِي نُعْمٍ، حَدَّثَنِي رَافِعُ بْنُ خَدِيجٍ، أَنَّهُ زَرَعَ أَرْضًا فَمَرَّ بِهِ النَّبِيُّ صلى الله عليه وسلم وَهُوَ يَسْقِيهَا فَسَأَلَهُ " لِمَنِ الزَّرْعُ وَلِمَنِ الأَرْضُ " . فَقَالَ زَرْعِي بِبَذْرِي وَعَمَلِي لِيَ الشَّطْرُ وَلِبَنِي فُلاَنٍ الشَّطْرُ . فَقَالَ " أَرْبَيْتُمَا فَرُدَّ الأَرْضَ عَلَى أَهْلِهَا وَخُذْ نَفَقَتَكَ " .
Traduction anglaise
Narrated Rafi' ibn Khadij: Rafi' had cultivated a land. The Prophet (ﷺ) passed him when he was watering it. So he asked him: To whom does the crop belong, and to whom does the land belong? He replied: The crop is mine for my seed and labour. The half (of the crop) is mine and the half for so-and-so. He said: You conducted usurious transaction. Return the land to its owner and take your wages and cost
Traduction en ourdou
ابن ابی نعم سے روایت ہے کہ مجھ سے رافع بن خدیج رضی اللہ عنہ نے بیان کیا کہ انہوں نے ایک زمین میں کھیتی کی تو نبی اکرم صلی اللہ علیہ وسلم کا وہاں سے گزر ہوا اور وہ اس میں پانی دے رہے تھے، آپ صلی اللہ علیہ وسلم نے ان سے پوچھا: کھیتی کس کی ہے اور زمین کس کی؟ تو انہوں کہا: میری کھیتی میرے بیج سے ہے اور محنت بھی میری ہے نصف پیداوار مجھے ملے گی اور نصف پیداوار فلاں شخص کو ( جو زمین کا مالک ہے ) آپ صلی اللہ علیہ وسلم نے فرمایا: تم دونوں نے ربا کیا ( یعنی یہ عقد ناجائز ہے ) زمین اس کے مالک کو لوٹا دو، اور تم اپنے خرچ اور اپنی محنت کی اجرت لے لو ۔
