Hadith 2274 — Livre 13: Divorce (Kitab Al-Talaq)
كتاب الطلاق
Rapporté par Amr b. Shu’aib, d’après son père, d’après son grand-père رضي الله عنه : Un homme s’est levé et a dit : « Messager d’Allah, untel est mon fils ; j’ai eu des rapports illicites avec sa mère à l’époque préislamique. » Le Messager d’Allah ﷺ a dit : « Il n’y a pas de revendication illicite de paternité en Islam. Ce qui était pratiqué avant l’Islam est annulé. L’enfant appartient à celui sur le lit duquel il est né, et l’adultère n’a aucun droit. »

حَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَخْبَرَنَا حُسَيْنٌ الْمُعَلِّمُ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ فُلاَنًا ابْنِي عَاهَرْتُ بِأُمِّهِ فِي الْجَاهِلِيَّةِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ دِعْوَةَ فِي الإِسْلاَمِ ذَهَبَ أَمْرُ الْجَاهِلِيَّةِ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ " .
Traduction anglaise
Amr b. Shu'aib on his father's authority said that his grandfather reported:A man got up and said: Messenger of Allah, so-and-so is my son; I had illicit intercourse with his mother in the pre-Islamic period. The Messenger of Allah (ﷺ) said: There is no unlawful claiming of paternity in Islam. What was done in pre-Islamic times has been annulled. The child is attributed to the one on whose bed it is born, and the fornicator is deprived of any right

عبداللہ بن عمرو رضی اللہ عنہما کہتے ہیں کہ ایک شخص کھڑا ہوا اور کہنے لگا: اللہ کے رسول! فلاں میرا بیٹا ہے میں نے زمانہ جاہلیت میں اس کی ماں سے زنا کیا تھا، تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: اسلام میں اس طرح کا مطالبہ صحیح نہیں، زمانہ جاہلیت کی بات ختم ہوئی، بچہ صاحب بستر کا ہے اور زانی کے لیے سنگساری ہے ۔
