Hadith 2270 — Livre 13: Divorce (Kitab Al-Talaq)
كتاب الطلاق
Rapporté par Zayd ibn Arqam رضي الله عنه : Trois personnes ont été amenées à Ali رضي الله عنه alors qu’il était au Yémen. Elles avaient eu des rapports avec une femme pendant une même période de pureté. Il a demandé à deux d’entre eux : « Reconnaissez-vous cet enfant pour cet homme ? » Ils ont répondu : « Non. » Il a alors posé la même question à chacun. Chaque fois qu’il interrogeait deux d’entre eux, ils répondaient non. Il a donc tiré au sort entre eux et a attribué l’enfant à celui qui a été choisi. Il lui a imposé les deux tiers du prix du sang (c’est-à-dire le prix de la mère). Cela a ensuite été rapporté au Prophète ﷺ, qui a tellement ri que ses molaires sont apparues

حَدَّثَنَا خُشَيْشُ بْنُ أَصْرَمَ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا الثَّوْرِيُّ، عَنْ صَالِحٍ الْهَمْدَانِيِّ، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ خَيْرٍ، عَنْ زَيْدِ بْنِ أَرْقَمَ، قَالَ أُتِيَ عَلِيٌّ - رضى الله عنه - بِثَلاَثَةٍ وَهُوَ بِالْيَمَنِ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَسَأَلَ اثْنَيْنِ أَتُقِرَّانِ لِهَذَا بِالْوَلَدِ قَالاَ لاَ . حَتَّى سَأَلَهُمْ جَمِيعًا فَجَعَلَ كُلَّمَا سَأَلَ اثْنَيْنِ قَالاَ لاَ . فَأَقْرَعَ بَيْنَهُمْ فَأَلْحَقَ الْوَلَدَ بِالَّذِي صَارَتْ عَلَيْهِ الْقُرْعَةُ وَجَعَلَ عَلَيْهِ ثُلُثَىِ الدِّيَةِ قَالَ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ صلى الله عليه وسلم فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ .
Traduction anglaise
Narrated Zayd ibn Arqam: Three persons were brought to Ali (Allah be pleased with him) when he was in the Yemen. They and sexual intercourse with a woman during a single state of purity. He asked two of them: Do you acknowledge this child for this (man)? They replied: No. He then put this (question) to all of them. Whenever he asked two of them, they replied in the negative. He, therefore, cast a lot among them, and attributed the child to the one who received the lot. He imposed two-third of the blood-money (i.e. the price of the mother) on him. This was then mentioned to the Prophet (ﷺ) and he laughed so much that his molar teeth appeared

زید بن ارقم رضی اللہ عنہ کہتے ہیں کہ علی رضی اللہ عنہ کے پاس یمن میں تین آدمی ( ایک لڑکے کے لیے جھگڑا لے کر ) آئے جنہوں نے ایک عورت سے ایک ہی طہر میں صحبت کی تھی، تو آپ نے ان میں سے دو سے پوچھا: کیا تم دونوں یہ لڑکا اسے ( تیسرے کو ) دے سکتے ہو؟ انہوں نے کہا: نہیں، اس طرح آپ نے سب سے دریافت کیا، اور سب نے نفی میں جواب دیا، چنانچہ ان کے درمیان قرعہ اندازی کی، اور جس کا نام نکلا اسی کو لڑکا دے دیا، نیز اس کے ذمہ ( دونوں ساتھیوں کے لیے ) دو تہائی دیت مقرر فرمائی، رسول اللہ صلی اللہ علیہ وسلم کے سامنے جب اس کا تذکرہ آیا تو آپ ہنسے یہاں تک کہ آپ کی کچلیاں ظاہر ہو گئیں۔
