Hadith 3480 — Livre 27: The Book of Divorce
كتاب الطلاق
Rapporté par Abu Hurairah : Alors que nous étions avec le Prophète, un homme s’est levé et a dit : "Ô Messager d’Allah, un garçon noir est né chez moi." Le Messager d’Allah a demandé : "Comment cela est-il arrivé ?" Il a répondu : "Je ne sais pas." Le Prophète a dit : "As-tu des chameaux ?" Il a répondu : "Oui." Il a demandé : "De quelle couleur sont-ils ?" Il a dit : "Rouges." Il a demandé : "Y a-t-il des chameaux gris parmi eux ?" Il a répondu : "Oui, il y a des chameaux gris." Il a demandé : "D’où viennent-ils ?" Il a répondu : "Je ne sais pas, ô Messager d’Allah ! Peut-être que c’est héréditaire." Il a dit : "Peut-être que c’est aussi héréditaire." À cause de cela, le Messager d’Allah a établi la règle suivante : "Il n’est pas permis à un homme de renier un enfant né dans son foyer, à moins qu’il ne dise avoir vu un acte immoral (fahishah)

أَخْبَرَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الْمُغِيرَةِ، قَالَ حَدَّثَنَا أَبُو حَيْوَةَ، - حِمْصِيٌّ - قَالَ حَدَّثَنَا شُعَيْبُ بْنُ أَبِي حَمْزَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ بَيْنَمَا نَحْنُ عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم قَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي وُلِدَ لِي غُلاَمٌ أَسْوَدُ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " فَأَنَّى كَانَ ذَلِكَ " . قَالَ مَا أَدْرِي قَالَ " فَهَلْ لَكَ مِنْ إِبِلٍ " . قَالَ نَعَمْ . قَالَ " فَمَا أَلْوَانُهَا " . قَالَ حُمْرٌ . قَالَ " فَهَلْ فِيهَا جَمَلٌ أَوْرَقُ " . قَالَ فِيهَا إِبِلٌ وُرْقٌ . قَالَ " فَأَنَّى كَانَ ذَلِكَ " . قَالَ مَا أَدْرِي يَا رَسُولَ اللَّهِ إِلاَّ أَنْ يَكُونَ نَزَعَهُ عِرْقٌ . قَالَ " وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ " . فَمِنْ أَجْلِهِ قَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم هَذَا لاَ يَجُوزُ لِرَجُلٍ أَنْ يَنْتَفِيَ مِنْ وَلَدٍ وُلِدَ عَلَى فِرَاشِهِ إِلاَّ أَنْ يَزْعُمَ أَنَّهُ رَأَى فَاحِشَةً .
Traduction anglaise
It was narrated that Abu Hurairah said:"While we were with the Prophet, a man stood up and said: 'O Messenger of Allah, a black boy has been born to me.' The Messenger of Allah said: 'How did that happen?' He said: 'I do not know.' He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray camels among them?' He said: 'There are some gray camels among them.' He said: 'Where do they come from?' He said: 'I do not know, O Allah's Messenger! Perhaps it is hereditary.' He said: 'Perhaps this is also hereditary.' Because of this, the Messenger of Allah decreed the following: 'It is not allowed for a man, to disown a child who was born on his bed, unless he claimed that he had seen an immoral act (Fahishah)

ابوہریرہ رضی الله عنہ کہتے ہیں کہ ایک روز ہم لوگ رسول اللہ صلی اللہ علیہ وسلم کے پاس بیٹھے ہوئے تھے کہ ایک شخص نے کھڑا ہو کر کہا: اللہ کے رسول! میرے یہاں ایک کالا بچہ پیدا ہوا ہے، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”کہاں سے آیا یہ اس کا کالا رنگ؟“، اس نے کہا: مجھے نہیں معلوم، آپ نے فرمایا: ”کیا تمہارے پاس اونٹ ہیں؟“، اس نے کہا: جی ہاں ہیں۔ آپ نے فرمایا: ”ان کے رنگ کیا ہیں؟“، اس نے کہا: سرخ ہیں، آپ نے فرمایا: ”کیا کوئی ان میں خاکی رنگ کا بھی ہے؟“، اس نے کہا: ان میں خاکی رنگ کے بھی اونٹ ہیں۔ آپ نے فرمایا: ”یہ خاکی رنگ کہاں سے آیا؟“، اس نے کہا: میں نہیں جانتا، اللہ کے رسول! ہو سکتا ہے کسی رگ نے اسے کشید کیا ہو ( یعنی یہ نسلی کشش کا نتیجہ ہو اور نسل میں کوئی کالے رنگ کا ہو ) ، آپ صلی اللہ علیہ وسلم نے فرمایا: ”اور یہ بھی ہو سکتا ہے کسی رگ کی کشش کے نتیجہ میں کالے رنگ کا پیدا ہوا ہو“۔ اسی وجہ سے رسول اللہ صلی اللہ علیہ وسلم نے یہ فیصلہ فرما دیا ہے کہ کسی شخص کے لیے یہ جائز نہیں ہے کہ وہ اپنی بیوی سے پیدا ہونے والے بچے کا انکار کر دے جب تک کہ وہ اس کا دعویٰ نہ کرے کہ اس نے اسے بدکاری کرتے ہوئے دیکھا ہے۔
