Rapporté par Al-Aswad : Mu`adh bin Jabal a donné ce verdict pour nous du vivant du Messager d’Allah (ﷺ) : la moitié de l’héritage revient à la fille et l’autre moitié à la sœur. Sulaiman a dit : Mu`adh a donné ce verdict pour nous, mais il n’a pas précisé que c’était du vivant du Messager d’Allah (ﷺ)

حَدَّثَنَا بِشْرُ بْنُ خَالِدٍ، حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، عَنْ شُعْبَةَ، عَنْ سُلَيْمَانَ، عَنْ إِبْرَاهِيمَ، عَنِ الأَسْوَدِ، قَالَ قَضَى فِينَا مُعَاذُ بْنُ جَبَلٍ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم النِّصْفُ لِلاِبْنَةِ وَالنِّصْفُ لِلأُخْتِ. ثُمَّ قَالَ سُلَيْمَانُ قَضَى فِينَا. وَلَمْ يَذْكُرْ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم.
Traduction anglaise
Narrated Al-Aswad:Mu`adh bin Jabal gave this verdict for us in the lifetime of Allah's Messenger (ﷺ). One-half of the inheritance is to be given to the daughter and the other half to the sister. Sulaiman said: Mu`adh gave a verdict for us, but he did not mention that it was so in the lifetime of Allah's Messenger (ﷺ)

ہم سے بشر بن خالد نے بیان کیا، کہا ہم سے محمد بن جعفر نے بیان کیا، ان سے شعبہ بن حجاج نے، ان سے سلیمان اعمش نے، ان سے ابراہیم نخعی نے اور ان سے اسود بن یزید نے بیان کیا کہ معاذ بن جبل رضی اللہ عنہ نے رسول اللہ صلی اللہ علیہ وسلم کے زمانہ میں ہمارے درمیان یہ فیصلہ کیا تھا کہ آدھا بیٹی کو ملے گا اور آدھا بہن کو۔ پھر سلیمان نے جو اس حدیث کو روایت کیا تو اتنا ہی کہا کہ معاذ نے ہم کنبہ والوں کو یہ حکم دیا تھا یہ نہیں کہا کہ نبی کریم صلی اللہ علیہ وسلم کے زمانہ میں۔
