Rapporté par ‘Urwa bin Az-Zubair : Une femme a commis un vol à l’époque du Messager d’Allah (ﷺ), lors de la bataille d’Al-Fath (c’est-à-dire la Conquête de La Mecque). Sa famille est allée voir Usama bin Zaid pour qu’il intercède en sa faveur auprès du Prophète. Quand Usama a plaidé pour elle auprès du Messager d’Allah (ﷺ), le visage du Prophète (ﷺ) a changé de couleur et il a dit : « Intercèdes-tu auprès de moi dans une affaire où il y a une peine légale fixée par Allah ? » Usama a dit : « Ô Messager d’Allah (ﷺ) ! Demande pardon à Allah pour moi. » L’après-midi, le Messager d’Allah (ﷺ) s’est levé et a parlé aux gens. Il a loué Allah comme Il le mérite puis a dit : « Après cela : Les nations avant vous ont été détruites car, si un noble parmi eux volait, ils le laissaient, mais si un pauvre volait, ils appliquaient la peine d’Allah contre lui. Par Celui qui détient l’âme de Muhammad dans Sa main, si Fatima, la fille de Muhammad, avait volé, je lui aurais coupé la main. » Ensuite, le Messager d’Allah (ﷺ) a donné l’ordre concernant cette femme et sa main a été coupée. Plus tard, elle s’est sincèrement repentie et s’est mariée. ‘Aïsha a dit : « Cette femme venait me voir et je transmettais ses demandes au Messager d’Allah (ﷺ). »

حَدَّثَنَا مُحَمَّدُ بْنُ مُقَاتِلٍ، أَخْبَرَنَا عَبْدُ اللَّهِ، أَخْبَرَنِي يُونُسُ، عَنِ الزُّهْرِيِّ، قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، أَنَّ امْرَأَةً، سَرَقَتْ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي غَزْوَةِ الْفَتْحِ، فَفَزِعَ قَوْمُهَا إِلَى أُسَامَةَ بْنِ زَيْدٍ يَسْتَشْفِعُونَهُ، قَالَ عُرْوَةُ فَلَمَّا كَلَّمَهُ أُسَامَةُ فِيهَا تَلَوَّنَ وَجْهُ رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " أَتُكَلِّمُنِي فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ". قَالَ أُسَامَةُ اسْتَغْفِرْ لِي يَا رَسُولَ اللَّهِ. فَلَمَّا كَانَ الْعَشِيُّ قَامَ رَسُولُ اللَّهِ صلى الله عليه وسلم خَطِيبًا، فَأَثْنَى عَلَى اللَّهِ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ " أَمَّا بَعْدُ، فَإِنَّمَا أَهْلَكَ النَّاسَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمِ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ، وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ، لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا ". ثُمَّ أَمَرَ رَسُولُ اللَّهِ صلى الله عليه وسلم بِتِلْكَ الْمَرْأَةِ، فَقُطِعَتْ يَدُهَا، فَحَسُنَتْ تَوْبَتُهَا بَعْدَ ذَلِكَ وَتَزَوَّجَتْ. قَالَتْ عَائِشَةُ فَكَانَتْ تَأْتِي بَعْدَ ذَلِكَ فَأَرْفَعُ حَاجَتَهَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم.
Traduction anglaise
Narrated `Urwa bin Az-Zubair:A lady committed theft during the lifetime of Allah's Messenger (ﷺ) in the Ghazwa of Al-Fath, ((i.e. Conquest of Mecca). Her folk went to Usama bin Zaid to intercede for her (with the Prophet). When Usama interceded for her with Allah's Messenger (ﷺ), the color of the face of Allah's Messenger (ﷺ) changed and he said, "Do you intercede with me in a matter involving one of the legal punishments prescribed by Allah?" Usama said, "O Allah's Messenger (ﷺ)! Ask Allah's Forgiveness for me." So in the afternoon, Allah's Apostle got up and addressed the people. He praised Allah as He deserved and then said, "Amma ba'du ! The nations prior to you were destroyed because if a noble amongst them stole, they used to excuse him, and if a poor person amongst them stole, they would apply (Allah's) Legal Punishment to him. By Him in Whose Hand Muhammad's soul is, if Fatima, the daughter of Muhammad stole, I would cut her hand." Then Allah's Messenger (ﷺ) gave his order in the case of that woman and her hand was cut off. Afterwards her repentance proved sincere and she got married. `Aisha said, "That lady used to visit me and I used to convey her demands to Allah's Messenger (ﷺ)

ہم سے محمد بن مقاتل نے بیان کیا، کہا کہ ہم کو عبداللہ بن مبارک نے خبر دی، انہیں یونس نے خبر دی، انہیں زہری نے، کہا کہ مجھے عروہ بن زبیر نے خبر دی کہ غزوہ فتح ( مکہ ) کے موقع پر ایک عورت نے نبی کریم صلی اللہ علیہ وسلم کے عہد میں چوری کر لی تھی۔ اس عورت کی قوم گھبرائی ہوئی اسامہ بن زید رضی اللہ عنہما کے پاس آئی تاکہ وہ نبی کریم صلی اللہ علیہ وسلم سے اس کی سفارش کر دیں ( کہ اس کا ہاتھ چوری کے جرم میں نہ کاٹا جائے ) ۔ عروہ نے بیان کیا کہ جب اسامہ رضی اللہ عنہ نے اس کے بارے میں نبی کریم صلی اللہ علیہ وسلم سے گفتگو کی تو آپ صلی اللہ علیہ وسلم کے چہرے کا رنگ بدل گیا اور آپ صلی اللہ علیہ وسلم نے فرمایا! تم مجھ سے اللہ کی قائم کی ہوئی ایک حد کے بارے میں سفارش کرنے آئے ہو۔ اسامہ رضی اللہ عنہ نے عرض کیا: میرے لیے دعا مغفرت کیجئے، یا رسول اللہ! پھر دوپہر بعد نبی کریم صلی اللہ علیہ وسلم نے صحابہ رضی اللہ عنہم کو خطاب کیا، اللہ تعالیٰ کی اس کے شان کے مطابق تعریف کرنے کے بعد فرمایا: امابعد! تم میں سے پہلے لوگ اس لیے ہلاک ہو گئے کہ اگر ان میں سے کوئی معزز شخص چوری کرتا تو اسے چھوڑ دیتے لیکن اگر کوئی کمزور چوری کر لیتا تو اس پر حد قائم کرتے اور اس ذات کی قسم جس کے ہاتھ میں محمد صلی اللہ علیہ وسلم کی جان ہے اگر فاطمہ بنت محمد بھی چوری کر لے تو میں اس کا ہاتھ کاٹوں گا۔ اس کے بعد نبی کریم صلی اللہ علیہ وسلم نے اس عورت کے لیے حکم دیا اور ان کا ہاتھ کاٹ دیا گیا۔ پھر اس عورت نے صدق دل سے توبہ کر لی اور شادی بھی کر لی۔ عائشہ رضی اللہ عنہا نے بیان کیا کہ بعد میں وہ میرے یہاں آتی تھیں۔ ان کو اور کوئی ضرورت ہوتی تو میں رسول اللہ صلی اللہ علیہ وسلم کے سامنے پیش کر دیتی۔
