Hadith 4479 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)

Rapporté par Anas b. Malik رضي الله عنه : Le Prophète ﷺ a infligé des coups avec des branches de palmier et des sandales pour la consommation de vin, et Abu Bakr a donné des coups de fouet. Quand ‘Umar est devenu calife, il a réuni les gens et leur a dit : « Les gens vivent maintenant près des points d’eau » — et selon la version de Musaddad : « près des villages et des points d’eau, que pensez-vous de la peine pour la consommation de vin ? » ‘Abd al-Rahman b. ‘Awf a dit : « Nous pensons que tu devrais appliquer la peine la plus légère. » Il a donc fixé la peine à huit coups de fouet. Abu Dawud a dit : Il a aussi été rapporté par Ibn Al ‘Arubah, de Qatadah, du Prophète ﷺ, qu’il a frappé quarante fois avec des branches de palmier et des sandales. Et Shu’bah l’a rapporté de Qatadah, d’après Anas, du Prophète ﷺ. Cette version précise : Il a frappé avec deux branches de palmier environ quarante fois

حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا هِشَامٌ، ح وَحَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنْ هِشَامٍ، - الْمَعْنَى - عَنْ قَتَادَةَ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم جَلَدَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ وَجَلَدَ أَبُو بَكْرٍ رضى الله عنه أَرْبَعِينَ فَلَمَّا وَلِيَ عُمَرُ دَعَا النَّاسَ فَقَالَ لَهُمْ إِنَّ النَّاسَ قَدْ دَنَوْا مِنَ الرِّيفِ - وَقَالَ مُسَدَّدٌ مِنَ الْقُرَى وَالرِّيفِ - فَمَا تَرَوْنَ فِي حَدِّ الْخَمْرِ فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ نَرَى أَنْ تَجْعَلَهُ كَأَخَفِّ الْحُدُودِ . فَجَلَدَ فِيهِ ثَمَانِينَ . قَالَ أَبُو دَاوُدَ رَوَاهُ ابْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ جَلَدَ بِالْجَرِيدِ وَالنِّعَالِ أَرْبَعِينَ . وَرَوَاهُ شُعْبَةُ عَنْ قَتَادَةَ عَنْ أَنَسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ضَرَبَ بِجَرِيدَتَيْنِ نَحْوَ الأَرْبَعِينَ .
Traduction anglaise
Anas b. Malik said:The Prophet (ﷺ) gave a beating with palm-branches and sandals for drinking wine and Abu Bakr gave lashes. When ‘Umar came to power, he called upon people and said to them: The people are living now near watering placing, and, according to Musaddad’s version, “near villages and watering places, so what do you say about the punishment for (drinking) wine? ‘Abd al-Rahman b. ‘Awf said: We think that you should prescribe the lightest punishment. So he fixed eight lashes for it. Abu Dawud said: It has also been transmitted by Ibn Al 'Arubah from Qatadah from the Prophet (ﷺ) to the effect that he gave a beating forty times with palm branches and sandals. And Shu'bah narrated it from Qatadah on the authority of Anas from Prophet (ﷺ). This version has: He gave a beating with two palm-branches about forty times

انس بن مالک رضی اللہ عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے شراب پینے پر کھجور کی ٹہنیوں اور جوتوں سے مارا، اور ابوبکر رضی اللہ عنہ نے چالیس کوڑے لگائے، پھر جب عمر رضی اللہ عنہ خلیفہ ہوئے تو آپ نے لوگوں کو بلایا، اور ان سے کہا: لوگ گاؤں سے قریب ہو گئے ہیں ( اور مسدد کی روایت میں ہے ) بستیوں اور گاؤں سے قریب ہو گئے ہیں ( یعنی شراب زیادہ پینے لگے ہیں ) تو اب شراب کی حد کے بارے میں تمہاری کیا رائے ہے؟ تو عبدالرحمٰن بن عوف نے ان سے کہا: ہماری رائے یہ ہے کہ سب سے ہلکی جو حد ہے وہی آپ اس میں مقرر کر دیں، چنانچہ اسی ( ۸۰ ) کوڑے مارنے کا حکم ہوا ( کیونکہ سب سے ہلکی حد یہی حدقذف تھی ) ۔ ابوداؤد کہتے ہیں: اسے ابن ابی عروبہ نے قتادہ سے، قتادہ نے نبی اکرم صلی اللہ علیہ وسلم سے مرفوعاً روایت کیا ہے کہ آپ صلی اللہ علیہ وسلم نے کھجور کی ٹہنیوں اور جوتوں سے چالیس مار ماریں۔ اور اسے شعبہ نے قتادہ سے، قتادہ نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے کہ آپ نے کھجور کی دو ٹہنیوں سے چالیس کے قریب مار ماریں۔
