Hadith 6757 — Livre 85: Laws of Inheritance (Al-Faraa'id)
كتاب الفرائض
Rapporté par Ibn `Umar : Aïcha, la mère des croyants, voulait acheter une esclave pour l’affranchir. Le maître de l’esclave a dit : « Nous sommes prêts à te la vendre à condition que son Wala’ soit pour nous. » Aïcha en a parlé au Messager d’Allah ﷺ, qui a dit : « Cette condition ne doit pas t’empêcher de l’acheter, car le Wala’ revient à celui qui affranchit (l’esclave). »

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ عَائِشَةَ أُمَّ الْمُؤْمِنِينَ، أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً تُعْتِقُهَا فَقَالَ أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا. فَذَكَرَتْ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " لاَ يَمْنَعُكِ ذَلِكِ، فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ ".
Traduction anglaise
Narrated Ibn `Umar:That Aisha, the mother of the Believers, intended to buy a slave girl in order to manumit her. The slave girl's master said, "We are ready to sell her to you on the condition that her Wala should be for us." Aisha mentioned that to Allah's Messenger (ﷺ) who said, "This (condition) should not prevent you from buying her, for the Wala is for the one who manumits (the slave)
Traduction en ourdou
ہم سے قتیبہ بن سعید نے بیان کیا، ان سے امام مالک رحمہ اللہ نے بیان کیا، ان سے نافع نے، ان سے ابن عمر رضی اللہ عنہما نے کہ ام المؤمنین عائشہ رضی اللہ عنہا نے ایک کنیز کو آزاد کرنے کے لیے خریدنا چاہا تو کنیز کے مالکوں نے کہا کہ ہم بیچ سکتے ہیں لیکن ولاء ہمارے ساتھ ہو گی۔ ام المؤمنین نے اس کا ذکر رسول اللہ صلی اللہ علیہ وسلم سے کیا تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ اس شرط کو مانع نہ بننے دو، ولاء ہمیشہ اسی کے ساتھ قائم ہوتی ہے جو آزاد کرے۔
