Hadith 6758 — Livre 85: Laws of Inheritance (Al-Faraa'id)

Rapporté par Al-Aswad : Aïcha a dit : « J’ai acheté Barira et ses maîtres ont posé comme condition que le Wala’ soit pour eux. » Aïcha en a parlé au Prophète ﷺ, qui a dit : « Affranchis-la, car le Wala’ revient à celui qui donne l’argent (c’est-à-dire paie le prix pour affranchir l’esclave). » Aïcha a ajouté : « Je l’ai donc affranchie. Ensuite, le Prophète a appelé Barira et lui a donné le choix de retourner ou non auprès de son mari. Elle a dit : « Même s’il me donnait beaucoup d’argent, je ne resterais pas avec lui. » Elle a donc choisi de ne pas retourner avec son mari

حَدَّثَنَا مُحَمَّدٌ، أَخْبَرَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنِ الأَسْوَدِ، عَنْ عَائِشَةَ ـ رضى الله عنها ـ قَالَتِ اشْتَرَيْتُ بَرِيرَةَ فَاشْتَرَطَ أَهْلُهَا وَلاَءَهَا، فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ " أَعْتِقِيهَا فَإِنَّ الْوَلاَءَ لِمَنْ أَعْطَى الْوَرِقَ ". قَالَتْ فَأَعْتَقْتُهَا ـ قَالَتْ ـ فَدَعَاهَا رَسُولُ اللَّهِ صلى الله عليه وسلم فَخَيَّرَهَا مِنْ زَوْجِهَا فَقَالَتْ لَوْ أَعْطَانِي كَذَا وَكَذَا مَا بِتُّ عِنْدَهُ. فَاخْتَارَتْ نَفْسَهَا.
Traduction anglaise
Narrated Al-Aswad:Aisha said, "I bought Barira and her masters stipulated that the Wala would be for them." Aisha mentioned that to the Prophet (ﷺ) and he said, "Manumit her, as the Wala is for the one who gives the silver (i.e. pays the price for freeing the slave)." Aisha added, "So I manumitted her. After that, the Prophet caller her (Barira) and gave her the choice to go back to her husband or not. She said, "If he gave me so much and so much (money) I would not stay with him." So she selected her ownself (i.e. refused to go back to her husband)

ہم سے محمد نے بیان کیا، کہا ہم کو جریر نے خبر دی، انہیں منصور نے، انہیں ابراہیم نے، انہیں اسود نے اور ان سے عائشہ رضی اللہ عنہا نے بیان کیا کہ میں نے بریرہ کو خریدنا چاہا تو ان کے مالکوں نے شرط لگائی کہ ولاء ان کے ساتھ قائم ہو گی۔ میں نے اس کا تذکرہ نبی کریم صلی اللہ علیہ وسلم سے کیا تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ انہیں آزاد کر دو، ولاء قیمت ادا کرنے والے ہی کے ساتھ قائم ہوتی ہے۔ بیان کیا کہ پھر میں نے آزاد کر دیا۔ پھر انہیں نبی کریم صلی اللہ علیہ وسلم نے بلایا اور ان کے شوہر کے معاملہ میں اختیار دیا۔ انہوں نے کہا کہ اگر مجھے یہ یہ چیزیں بھی وہ دیدے تو میں اس کے ساتھ رات گزارنے کے لیے تیار نہیں۔ چنانچہ اس نے شوہر سے علیحدگی کو پسند کیا۔
