Rapporté par Anas : Umm Haritha, la sœur de Rubayyi’ (elle était la tante paternelle d’Anas), blessa une personne (elle lui cassa les dents). Le différend fut soumis au Messager d’Allah ﷺ. Il dit : « Rétribution, rétribution. » Umm Rubayyi’ demanda : « Ô Messager d’Allah, la rétribution sera-t-elle appliquée à untelle ? Par Allah, cela n’arrivera pas. » Le Prophète ﷺ répondit : « Gloire à Allah ! Ô Umm Rubayyi’, la rétribution (qisas) est un commandement dans le Livre d’Allah. » Elle dit : « Non, par Allah, la rétribution ne sera jamais appliquée contre elle », et elle insista jusqu’à ce que les proches de la victime acceptent une compensation. Le Messager d’Allah ﷺ dit alors : « Il y a parmi les serviteurs d’Allah des gens pieux qui, s’ils jurent par Allah, Il exauce leur serment. »

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَفَّانُ بْنُ مُسْلِمٍ، حَدَّثَنَا حَمَّادٌ، أَخْبَرَنَا ثَابِتٌ، عَنْ أَنَسٍ، أَنَّ أُخْتَ الرُّبَيِّعِ أُمَّ حَارِثَةَ، جَرَحَتْ إِنْسَانًا فَاخْتَصَمُوا إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْقِصَاصَ الْقِصَاصَ " . فَقَالَتْ أُمُّ الرَّبِيعِ يَا رَسُولَ اللَّهِ أَيُقْتَصُّ مِنْ فُلاَنَةَ وَاللَّهِ لاَ يُقْتَصُّ مِنْهَا . فَقَالَ النَّبِيُّ صلى الله عليه وسلم " سُبْحَانَ اللَّهِ يَا أُمَّ الرَّبِيعِ الْقِصَاصُ كِتَابُ اللَّهِ " . قَالَتْ لاَ وَاللَّهِ لاَ يُقْتَصُّ مِنْهَا أَبَدًا . قَالَ فَمَا زَالَتْ حَتَّى قَبِلُوا الدِّيَةَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللَّهِ لأَبَرَّهُ " .
Traduction anglaise
Anas reported that Umm Haritha, the sister of Rubayyi' (she was the father's sister of Hadrat Anas) injured a person (she broke his teeth). The dispute was referred to Allah's Apostle (ﷺ). Allah's Messenger (ﷺ) said:Retribution, retribution. Umm Rubayyi' said: Messenger of Allah, will retribution be taken from so and so? By Allah, it shall not be taken from her (i. e. from Umm Haritha). Thereupon Allah's Apostle said: Hallowed be Allah. O Umm Rubayyi', Qisas (retribution is a command, prescribed) in the Book of Allah. She said: No, by Allah, Qisas will never be taken from her; and she went on saying this until they (the relatives of the one who had been injured) accepted the blood-wit. Thereupon Allah's Messenger (ﷺ) said: Verily there are amongst the servants of Allah (such pious persons) who, if they take oath of Allah, He honours it
Traduction en ourdou
حضرت انس رضی اللہ عنہ سے روایت ہے کہ رُبیع رضی اللہ عنہا ( بنت نضر بن ضمضم ) کی بہن ، ام حارثہ نے کسی انسان کو زخمی کیا ( انہوں نے ایک لڑکی کو تھپڑ مار کر اس کا دانت توڑ دیا ، صحیح بخاری ) تو وہ مقدمہ لے کر نبی صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے ، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا : " قصاص! قصاص! " تو ام رُبیع رضی اللہ عنہا نے کہا : اے اللہ کے رسول! کیا فلاں عورت سے قصاص لیا جائے گا؟ اللہ کی قسم! اس سے قصاص نہیں لیا جائے گا ، اس پر نبی صلی اللہ علیہ وسلم نے فرمایا : " سبحان اللہ! اے ام ربیع! قصاص اللہ کی کتاب ( کا حصہ ) ہے ۔ " انہوں نے کہا : نہیں ، اللہ کی قسم! اس سے کبھی قصاص نہیں لیا جائے گا ( اللہ تعالیٰ اپنے فضل سے ایسا نہیں ہونے دے گا ۔ ) کہا : وہ مسلسل اسی بات پر ( ڈٹی ) رہیں حتی کہ وہ لوگ دیت پر راضی ہو گئے ۔ تو اس پر رسول اللہ صلی اللہ علیہ وسلم نے فرمایا : " اللہ کے بندوں میں سے کچھ ایسے ہیں کہ اگر وہ اللہ پر قسم کھائیں تو وہ ضرور اسے سچا کر دیتا ہے
