كتاب العتق
Rapporté par Aïcha رضي الله عنها : Barira vint me voir et me dit : « Ma famille (mes propriétaires) a conclu un contrat avec moi pour ma liberté contre neuf ‘uqiyas (d’argent), à payer en neuf ans, une ‘uqiya chaque année. Aide-moi à payer. » Je lui dis : « Si ta famille est d’accord, je suis prête à leur payer la totalité en une seule fois pour t’affranchir, mais le droit d’héritage me reviendra si je le fais. » Barira en parla à sa famille, mais ils refusèrent sauf à condition que le droit d’héritage reste avec eux. Elle revint me le dire. Aïcha dit : « Je l’ai réprimandée. » Barira répondit : « Par Allah, ce n’est pas possible (ils n’accepteront jamais). » Pendant qu’elle disait cela, le Messager d’Allah ﷺ entendit et me demanda, je l’informai, et il dit : « Achète-la et affranchis-la, et laisse-leur le droit d’héritage, car ils ne peuvent pas le réclamer à juste titre, puisque ce droit revient à celui qui affranchit (l’esclave ; donc, ces gens n’ont aucun droit de faire de telles revendications). » Et je l’ai fait. Aïcha dit : Ensuite, le Messager d’Allah ﷺ fit un sermon le soir. Il glorifia Allah et Le loua comme Il le mérite, puis dit : « Qu’arrive-t-il aux gens qui posent des conditions qui ne sont pas dans le Livre d’Allah ? Toute condition qui n’est pas dans le Livre d’Allah est invalide, même si elle est répétée cent fois. Le Livre d’Allah est plus vrai que tout autre acte, et la condition posée par Allah est plus contraignante que toute autre condition. Qu’arrive-t-il à certains parmi vous qui disent : “Affranchis untel, mais le droit d’héritage me revient” ? En vérité, le droit d’héritage revient à celui qui affranchit. »

وَحَدَّثَنَا أَبُو كُرَيْبٍ، مُحَمَّدُ بْنُ الْعَلاَءِ الْهَمْدَانِيُّ حَدَّثَنَا أَبُو أُسَامَةَ، حَدَّثَنَا هِشَامُ، بْنُ عُرْوَةَ أَخْبَرَنِي أَبِي، عَنْ عَائِشَةَ، قَالَتْ دَخَلَتْ عَلَىَّ بَرِيرَةُ فَقَالَتْ إِنَّ أَهْلِي كَاتَبُونِي عَلَى تِسْعِ أَوَاقٍ فِي تِسْعِ سِنِينَ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ . فَأَعِينِينِي . فَقُلْتُ لَهَا إِنْ شَاءَ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَأُعْتِقَكِ وَيَكُونَ الْوَلاَءُ لِي فَعَلْتُ . فَذَكَرَتْ ذَلِكَ لأَهْلِهَا فَأَبَوْا إِلاَّ أَنْ يَكُونَ الْوَلاَءُ لَهُمْ فَأَتَتْنِي فَذَكَرَتْ ذَلِكَ قَالَتْ فَانْتَهَرْتُهَا فَقَالَتْ لاَهَا اللَّهِ إِذَا قَالَتْ . فَسَمِعَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَسَأَلَنِي فَأَخْبَرْتُهُ فَقَالَ " اشْتَرِيهَا وَأَعْتِقِيهَا وَاشْتَرِطِي لَهُمُ الْوَلاَءَ فَإِنَّ الْوَلاَءَ لِمَنْ أَعْتَقَ " . فَفَعَلْتُ - قَالَتْ - ثُمَّ خَطَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَشِيَّةً فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ " أَمَّا بَعْدُ فَمَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ كِتَابُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ مَا بَالُ رِجَالٍ مِنْكُمْ يَقُولُ أَحَدُهُمْ أَعْتِقْ فُلاَنًا وَالْوَلاَءُ لِي إِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ " .
Traduction anglaise
A'isha (Allah be pleased with her) reported:Barira came to me and said: My family (owners) have made contract with me (for granting freedom) for nine 'uqiyas (of silver) payable in nine years, one 'uqiya every year. Help me (in making this payment). I said to her: If your family so desires, I am prepared to make them the full payment in one instalment, and thus secure freedom for you, but the right of inheritance will vest in me, if I do so. She (Barira) made a mention of that to her family, but they refused (except) on the condition that the right of inheritance would vest in them. She came to me and made mention of if She ('A'isha) said: I scolded her. She (Barira) said: By Allah, it is not possible (they will never agree to it). And as she was saying it, Allah's messenger (ﷺ) heard, and he asked me, I informed him and he said: Buy her and emancipate her, and let the right of inherit- ance vest in them, for they cannot claim it (rightfully) since the right of inherritance vests with one who emancipates (the slave; therefore, these people have no right to lay such false claims). And I did so. She ('A'isha) said: Then Allah's Messenger (ﷺ) delivered a sermon in the evening. He extolled Allah and praised Him with what He deserves, and then said afterwards,: What has happened to the people that they lay down conditions which are not found in the Book of Allah? And the condition which is not found in the Book of Allah is invalid, even if its number is one hundred. The Book of Allah is more true (than any other deed) and the condition laid down by Allah is more binding (than any other condition). What has happened to the people among you that someone among you says:" Emancipate so and so, but the right of inheritance vests in me"? Verily, the right of inheritance vests in one who emancipates

ابواسامہ نے کہا : ہمیں ہشام بن عروہ نے حدیث بیان کی ، انہوں نے کہا : مجھے میرے والد نے حضرت عائشہ رضی اللہ عنہا سے خبر دی ، انہوں نے کہا : بریرہ میرے پاس آئی اور کہنے لگی : میرے مالکوں نے میرے ساتھ 9 سالوں میں 9 اوقیہ ( کی ادائیگی ) کے بدلے مکاتبت کی ہے ۔ ہر سال میں ایک اوقیہ ( ادا کرنا ) ہے ۔ میری مدد کریں ۔ میں نے اس سے کہا : اگر تمہارے مالک چاہیں کہ میں انہیں یکمشت گن کر دوں اور تمہیں آزاد کر دوں اور ولاء کا حق میرا ہو ، تو میں ایسا کر لوں گی ۔ اس نے یہ بات اپنے مالکوں سے کی تو انہوں نے ( اسے ماننے سے ) انکار کر دیا الا یہ کہ حقِ ولاء ان کا ہو ۔ اس کے بعد وہ میرے پاس آئی اور یہ بات مجھے بتائی ۔ کہا : تو میں نے اس پر برہمی کا اظہار کیا ، اور کہا : اللہ کی قسم! پھر ایسا نہیں ہو سکتا ۔ رسول اللہ صلی اللہ علیہ وسلم نے یہ بات سنی تو مجھ سے پوچھا ، میں نے آپ کو ( پوری ) بات بتائی تو آپ صلی اللہ علیہ وسلم نے فرمایا : " اسے خریدو اور آزاد کر دو ، ان کے لیے ولاء کی شرط رکھ لو ، کیونکہ ( اصل میں تو ) ولاء کا حق اسی کا ہے جس نے آزاد کیا ۔ " میں نے ایسا ہی کیا ۔ کہا : پھر رسول اللہ صلی اللہ علیہ وسلم نے شام کے وقت خطبہ دیا ، اللہ کی حمد و ثنا جو اس کے شایانِ شان تھی بیان کی ، پھر فرمایا : " امابعد! لوگوں کو کیا ہوا ہے؟ وہ ایسی شرطیں رکھتے ہیں جو اللہ کی کتاب میں ( جائز ) نہیں ۔ جو بھی شرط اللہ کی کتاب میں ( روا ) نہیں ، وہ باطل ہے ، چاہے وہ سو شرطیں ہوں ، اللہ کی کتاب ہی سب سے سچی اور اللہ کی شرط سب سے مضبوط ہے ۔ تم میں سے بعض لوگوں کو کیا ہوا ہے ، ان میں سے کوئی کہتا ہے : فلاں کو آزاد تم کرو اور حقِ ولاء میرا ہو گا ۔ ( حالانکہ ) ولاء کا حق اسی کا ہے جس نے آزاد کیا
