Hadith 3666 — Livre 18: The Book of Divorce
كتاب الطلاق
Rapporté par Anas b. Sirin : J’ai demandé à Ibn ‘Umar رضي الله عنه au sujet de la femme qu’il avait divorcée. Il a dit : « Je l’ai divorcée alors qu’elle avait ses règles. Cela a été mentionné à ‘Umar رضي الله عنه, qui en a parlé au Messager d’Allah ﷺ, et il a dit : Ordonne-lui de la reprendre et, quand la période de règles sera terminée, alors (il pourra la divorcer dans sa pureté). » Il (Ibn ‘Umar) a dit : « Je l’ai donc reprise, puis je l’ai divorcée dans sa pureté. » J’ai (le rapporteur) demandé : « As-tu compté ce divorce que tu as prononcé pendant ses règles ? » Il a répondu : « Pourquoi ne l’aurais-je pas compté ? Est-ce que j’étais impuissant ou ignorant ? »

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ عَبْدِ الْمَلِكِ، عَنْ أَنَسِ بْنِ، سِيرِينَ قَالَ سَأَلْتُ ابْنَ عُمَرَ عَنِ امْرَأَتِهِ الَّتِي، طَلَّقَ فَقَالَ طَلَّقْتُهَا وَهْىَ حَائِضٌ فَذُكِرَ ذَلِكَ لِعُمَرَ فَذَكَرَهُ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ " مُرْهُ فَلْيُرَاجِعْهَا فَإِذَا طَهَرَتْ فَلْيُطَلِّقْهَا لِطُهْرِهَا " . قَالَ فَرَاجَعْتُهَا ثُمَّ طَلَّقْتُهَا لِطُهْرِهَا . قُلْتُ فَاعْتَدَدْتَ بِتِلْكَ التَّطْلِيقَةِ الَّتِي طَلَّقْتَ وَهْىَ حَائِضٌ قَالَ مَا لِيَ لاَ أَعْتَدُّ بِهَا وَإِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ .
Traduction anglaise
Anas b. Sirin reported:I asked Ibn 'Umar (Allah be pleased with them) about the woman whom he had divorced. He said: I divorced her while she was in the state of menses. It was mentioned to 'Umar (Allah be pleased with him) and he then made a mention of that to Allah's Apostle (ﷺ), whereupon he said: Command him to take her back and when the period of menses is over, then (he may divorce her in the state of her purity. He (Ibn Umar) said: So I took her back, then divorced her in her purity. I (the narrator) said: Did you count that divorce which you pronounced in the state of menses? He said: Why should I not have counted that? Was I helpless or foolish?

عبدالملک نے انس بن سیرین سے روایت کی ، انہوں نے کہا : میں نے حضرت ابن عمر رضی اللہ عنہ سے ان کی اس بیوی کے بارے میں سوال کیا جسے انہوں نے طلاق دی تھی ۔ انہوں نے کہا : میں نے اسے حالت حیض میں طلاق دی تھی ۔ میں نے یہ بات حضرت عمر رضی اللہ عنہ کو بتائی تو انہوں نے یہی بات نبی صلی اللہ علیہ وسلم کو بتائی ۔ اس پر آپ نے فرمایا : " اسے حکم دو کہ وہ اس سے رجوع کرے اور جب وہ پاک ہو جائے تو اسے اس کے طہر میں طلاق دے ۔ " کہا : میں نے اس ( بیوی ) سے رجوع کیا ، پھر اس کے طہر میں اسے طلاق دی ۔ میں نے پوچھا : آپ نے وہ طلاق شمار کی جو اسے حالت حیض میں دی تھی؟ انہوں نے جواب دیا : میں اسے کیوں شمار نہ کرتا؟ اگر میں خود ہی ( صحیح طریقہ اپنانے سے ) عاجز رہا تھا اور حماقت سے کام لیا تھا ( تو کیا طلاق شمار نہ ہو گی)
