Rapporté par `Amr : Quand j'ai mentionné cela (c'est-à-dire le récit de Rafi` bin Khadij : n° 532) à Tawus, il a dit : « Il est permis de louer la terre pour la cultiver, car Ibn `Abbas a dit : ‘Le Prophète (ﷺ) ne l'a pas interdit, mais il a dit : Il vaut mieux donner la terre gratuitement à son frère que de lui demander un loyer fixe.’ »

حَدَّثَنَا قَبِيصَةُ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرٍو، قَالَ ذَكَرْتُهُ لِطَاوُسٍ فَقَالَ يُزْرِعُ، قَالَ ابْنُ عَبَّاسٍ ـ رضى الله عنهما ـ إِنَّ النَّبِيَّ صلى الله عليه وسلم لَمْ يَنْهَ عَنْهُ وَلَكِنْ قَالَ " أَنْ يَمْنَحَ أَحَدُكُمْ أَخَاهُ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ شَيْئًا مَعْلُومًا ".
Traduction anglaise
Narrated `Amr:When I mentioned it (i.e. the narration of Rafi` 'bin Khadij: no. 532) to Tawus, he said, "It is permissible to rent the land for cultivation, for Ibn `Abbas said, 'The Prophet (ﷺ) did not forbid that, but said: One had better give the land to one's brother gratis rather than charge a certain amount for it
Traduction en ourdou
ہم سے قبیصہ نے بیان کیا، کہا کہ ہم سے سفیان ثوری نے بیان کیا، ان سے عمرو بن دینار نے بیان کیا کہ میں نے اس کا (یعنی رافع بن خدیج رضی اللہ عنہ کی مذکورہ حدیث کا) ذکر طاؤس سے کیا تو انہوں نے کہا کہ ( بٹائی وغیرہ پر ) کاشت کرا سکتا ہے ابن عباس رضی اللہ عنہما نے فرمایا تھا کہ نبی کریم صلی اللہ علیہ وسلم نے اس سے منع نہیں کیا تھا۔ البتہ آپ صلی اللہ علیہ وسلم نے یہ فرمایا تھا کہ اپنے کسی بھائی کو زمین بخشش کے طور پر دے دینا اس سے بہتر ہے کہ اس پر کوئی محصول لے۔ ( یہ اس صورت میں کہ زمیندار کے پاس فالتو زمین بیکار پڑی ہو ) ۔
