كتاب المزارعة
Rapporté par Jabir : Les gens avaient l'habitude de louer leurs terres pour la culture en échange d'un tiers, d'un quart ou de la moitié de la récolte. Le Prophète a dit : « Celui qui possède une terre doit la cultiver lui-même ou la donner gratuitement à son frère (musulman) ; sinon, il doit la laisser en jachère. » Rapporté par Abu Huraira : Le Messager d'Allah (ﷺ) a dit : « Celui qui possède une terre doit la cultiver lui-même ou la donner gratuitement à son frère (musulman) ; sinon, il doit la laisser en jachère. »

حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، أَخْبَرَنَا الأَوْزَاعِيُّ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ ـ رضى الله عنه ـ قَالَ كَانُوا يَزْرَعُونَهَا بِالثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ فَقَالَ النَّبِيُّ صلى الله عليه وسلم " مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا، فَإِنْ لَمْ يَفْعَلْ فَلْيُمْسِكْ أَرْضَهُ ". وَقَالَ الرَّبِيعُ بْنُ نَافِعٍ أَبُو تَوْبَةَ حَدَّثَنَا مُعَاوِيَةُ، عَنْ يَحْيَى، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَخَاهُ، فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ ".
Traduction anglaise
Narrated Jabir:The people used to rent their land for cultivation for one-third, one-fourth or half its yield. The Prophet said, "Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise keep it uncultivated." Narrated Abu Huraira: Allah's Messenger (ﷺ) said, "Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise he should keep it uncultivated
