كتاب البيوع
Rapporté par `Abdullah bin `Umar : `Aisha, la mère des croyants, voulait acheter une esclave et l’affranchir, mais ses maîtres ont dit qu’ils ne la vendraient qu’à condition que le Wala’ leur revienne. `Aisha en a parlé au Messager d’Allah (ﷺ). Il a dit : « Ce qu’ils exigent ne doit pas t’empêcher de l’acheter, car le Wala’ revient à celui qui affranchit. »

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّ عَائِشَةَ، أُمَّ الْمُؤْمِنِينَ أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً فَتُعْتِقَهَا، فَقَالَ أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا. فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " لاَ يَمْنَعُكِ ذَلِكَ، فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ ".

Narrated `Abdullah bin `Umar:Aisha, (mother of the faithful believers) wanted to buy a slave girl and manumit her, but her masters said that they would sell her only on the condition that her Wala' would be for them. `Aisha told Allah's Messenger (ﷺ) of that. He said, "What they stipulate should not hinder you from buying her, as the Wala' is for the manumitted
Traduction en ourdou
ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم کو امام مالک رحمہ اللہ نے خبر دی، انہیں نافع نے اور انہیں عبداللہ بن عمر رضی اللہ عنہما نے کہ ام المؤمنین عائشہ رضی اللہ عنہا نے چاہا کہ ایک باندی کو خرید کر آزاد کر دیں، لیکن ان کے مالکوں نے کہا کہ ہم انہیں اس شرط پر آپ کو بیچ سکتے ہیں کہ ان کی ولاء ہمارے ساتھ رہے۔ اس کا ذکر جب عائشہ رضی اللہ عنہا نے رسول اللہ صلی اللہ علیہ وسلم کے سامنے کیا تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ اس شرط کی وجہ سے تم قطعاً نہ رکو۔ ولاء تو اسی کی ہوتی ہے جو آزاد کرے۔
